The state Senate voted Wednesday to outlaw smoking in vehicles when children 12 or under are present.
The legislation went to the House on a vote of 26-12, over the objections of lawmakers who complained it was overreaching.
"At what point do free people say ... thou shalt not tell me any more what to do?" said Sen. William Sharer, a Farmington Republican.
The proposal would expand the New Mexico law that already bans smoking in most offices, restaurants, bars, buses, taxis and other indoor public places.
Supporters said children are particularly vulnerable to the health effects of secondhand cigarette smoke.
Opponents of the legislation argued the proposed ban wouldn't be enforced consistently, and that enforcing it wasn't a good use of police resources....
"Do we stop people from smoking in their homes in the winter time?" said Sen. Phil Griego, D-San Jose. "I think what we're doing here is overstepping our bounds."

I heard a great sermon awhile back and the basic point was that when people refuse to act morally and follow God’s laws out of disbelief, they fill the gap with a quagmire of man’s stupid laws and, yep, that’s what we’re getting. God’s 10 are so simple. Love your neighbor as yourself. The entire gospel and law can be summed up as Loving God and loving others. A truly loving parent would not smoke around children; not just because it’s unhealthy but b/c it is horribly unpleasant. Growing up with two smoking parents, I have some awful memories of being stuck in a car with them both puffing away and me gagging - also being burned accidentally as well.
I’d rather live under the freedom of God’s laws than all of man’s baloney.

A couple more bills are moving through our wacky legislature which is controlled by Democrats such that the Republicans can not stop legislation unless they form a coalition with some Dems. However, those Dems are under continual threat from King Bill to deep six necessary projects in their home district. Here are a couple of them:
- New Mexicans could register to vote at early voting sites and cast a ballot on the same day under legislation approved by the House on Wednesday. Under current law, voter registration shuts down almost a month before an election. Supporters say the proposal will help increase voter turnout in elections. Opponents argued that the potential for voter fraud will increase by allowing registration and voting on the same day unless New Mexico implements stronger voter identification requirements. The House approved the bill on a 40-27 mostly party-line vote and sent it to the Senate. Republicans and three Democrats opposed the bill.
- The House approved a proposal (HB291) Tuesday to help enforce tougher vehicle-emissions standards the state plans for new cars, light trucks and sport utility vehicles. The legislation would allow the Motor Vehicle Division to refuse to register a vehicle that doesn't comply with emission requirements, which are to apply starting with 2011 model cars. Those will become available to consumers next year. Without the proposed enforcement legislation, New Mexicans could buy a car in another state without the tougher emissions standards and register it New Mexico, said Rep. Mimi Stewart, D-Albuquerque, a sponsor of the measure.

So now a perfectly legal activity is now grounds to be detained and cited by law enforcement depending on the age makeup of the vehicle’s occupants as observed by the officer. We have fallen so far as a supposedly free nation it boggles the mind. In North Korea they just oppress you without any pretext. Here they give you the illusion of freedom, but control with an iron fist every last detail of daily life.

I simply turn on the Golden EIB Microphone and share my honest passions and beliefs with people. And theyre free to go elsewhere. Theyre free to ignore; theyre free to believe; theyre free to be entertained, I dont care. Theyre free to do whatever they want.
But a lot of people arent free to smoke cigarettes where they want; theyre not free to drink where they want; theyre not free to eat the kind of food they want to eat; theyre not free to eat trans fats; theyre not free to drive certain places. Pretty soon were going to be told what kind of cars we have to drive. I cant cause that. I cant restrict anybodys freedom. Weve elected a guy who can, does, and wants to, all under the guise of saving us. So I appreciate the effort, and I appreciate somewhat losing my temper here. But dont compare me ever to an authoritarian who thinks so little of people that without him they can barely breathe on their own. Dont ever do that.

Hey, give me medical evidence that those of twelve years of age are more able to tolerate second hand smoke.
Now, give me the data, we live in fascism.
Damn. Just, damn.
