Ex-sailor's terrorism-support conviction tossed

NEW HAVEN, Conn. (AP) - A federal judge has thrown out a former Navy sailor's conviction on providing support to terrorists. But upheld Wednesday was Hassan Abu Jihaad's (hah-SAHN' AH'-boo zhee-HAHD) conviction for disclosing classified information.

Prosecutors say they are reviewing the ruling.

Abu-Jihaad's conviction was hailed last year by top national security officials and federal investigators as a model of cooperation among government agencies.

Abu-Jihaad was a signalman aboard the USS Benfold. He was accused of passing along information a drawing of the formation the group would use to pass through the dangerous Strait of Hormuz

He should have been charged with treason and executed upon the reading of the verdict.

What the h**k is the difference? he did not support the terrorists—he did support them by giving them classified information. This “judge” like so many should be tarred and feathered.

Yep .. and Jihaad boy should be keelhauled ... I suggest a Nimitz-class for the keelhauling. If he survives, hang him from the yardarm. Or whatever passes for a yardarm on a modern warship.

This is the result of treating terrorists as criminals. This man should have been tried in a military Courts Martial and convicted of treason. He could have been executed or given a life sentence in accordance with military Justice. At least he should have received the same sentence as John Walker and his son.

It depends on the wording of the criminal statute. Federal criminal law is not based on common law. In other words, if some action is not specifically mentioned in the Federal Criminal Code, it is not a federal crime. Most states have a criminal code that also incorporates the common law.

US Code: Title 18,21381

§ 2381. Treason

Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.

They say treason his hard to prove because it requires two witnesses. But, what ever you call it, what this Sailor did was clearly treason.

From that Yahool story I think I can infer that he will go to prison for 10 years, and can then be deported back to the UK. I wish the story would have been a little more detailed on why the judge rejected the language of the law, and dismissed his conviction. He should have been tossed overboard. What is crystal clear is that he betrayed this country and endangered the lives of many sailors. He should have been executed.

I'm going to assume that wasn't a rhetorical question.

On 1/20/09 the word "terror" and its derivatives were removed from the English language.

Therefore, legally, there is no such thing as a "terrorist".

And therefore Hassan Abu Jihaad could not have disclosed information to "terrorists" because no such thing exists, citizen.

The judge was appointed by President Bush (43) and had been a Clerk to Chief Justice Rehnquist, hardly a far left bio.

The law is not written by judges. If it was poorly written, a conscientious judge would have had no choice but to follow it.
