NEW HAVEN, Conn. (AP) - A federal judge has thrown out a former Navy sailor's conviction on providing support to terrorists. But upheld Wednesday was Hassan Abu Jihaad's (hah-SAHN' AH'-boo zhee-HAHD) conviction for disclosing classified information.
Prosecutors say they are reviewing the ruling.
Abu-Jihaad's conviction was hailed last year by top national security officials and federal investigators as a model of cooperation among government agencies.
Abu-Jihaad was a signalman aboard the USS Benfold. He was accused of passing along information a drawing of the formation the group would use to pass through the dangerous Strait of Hormuz

Ping.
Why is this man still alive?
oh boy. hey let them all go and stop taking prisoners.
why am I not surprised?
He should have been charged with treason and executed upon the reading of the verdict.

Yep .. and Jihaad boy should be keelhauled ... I suggest a Nimitz-class for the keelhauling. If he survives, hang him from the yardarm. Or whatever passes for a yardarm on a modern warship.
Why is this scum being coddled?

Why didn’t this sailor’s shipmates just introduce him to Davy Jones one dark night?
It depends on the wording of the criminal statute. Federal criminal law is not based on common law. In other words, if some action is not specifically mentioned in the Federal Criminal Code, it is not a federal crime. Most states have a criminal code that also incorporates the common law.
A sign of our times and the current administration.
Let's put this guy in charge the judge's security.
Why did he get an honorable discharge?
US Code: Title 18,21381
§ 2381. Treason
Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.
They say treason his hard to prove because it requires two witnesses. But, what ever you call it, what this Sailor did was clearly treason.

“Key terror conviction against ex-sailor is tossed”

NEW HAVEN, Conn.
SNIPPET: “Prosecutors say investigators discovered files on a computer disk recovered from a suspected terrorist supporter’s home in London that included the ship movements, as well as the number and type of personnel on each ship and the ships’ capabilities.
Abu-Jihaad was charged in the same case that led to the 2004 arrest of Babar Ahmad, a British computer specialist accused of running Web sites to raise money, appeal for fighters and provide equipment such as gas masks and night vision goggles to terrorists.”
From that Yahool story I think I can infer that he will go to prison for 10 years, and can then be deported back to the UK. I wish the story would have been a little more detailed on why the judge rejected the language of the law, and dismissed his conviction. He should have been tossed overboard. What is crystal clear is that he betrayed this country and endangered the lives of many sailors. He should have been executed.
I'm going to assume that wasn't a rhetorical question.
On 1/20/09 the word "terror" and its derivatives were removed from the English language.
Therefore, legally, there is no such thing as a "terrorist".
And therefore Hassan Abu Jihaad could not have disclosed information to "terrorists" because no such thing exists, citizen.
The judge was appointed by President Bush (43) and had been a Clerk to Chief Justice Rehnquist, hardly a far left bio.
The law is not written by judges. If it was poorly written, a conscientious judge would have had no choice but to follow it.
