Yesterday President Barack Obama announced his nominee to replace retiring Supreme Court Justice David Souter. She is federal circuit court judge Sonia Sotomayor. What sorts of questions should senators and the American people ask a nominee to the Supreme Court?

Justice Stevens of the current court came in for a fair share of criticism (all justified in my view) for his expansive reading in Kelo v. City of New London (2005) of the public use language. Of course, the takings clause of the Fifth Amendment is as complex as it is short: Nor shall private property be taken for public use, without just compensation. But he was surely done one better in the Summary Order in Didden v. Village of Port Chester issued by the Second Circuit in 2006. Judge Sotomayor was on the panel that issued the unsigned opinionone that makes Justice Stevens look like a paradigmatic defender of strong property rights.

Does it trouble you that the only reason you were picked for this position over other, much more qualified individuals, was because of your race and sex?
I would ask her if she recognized any of the following names: Deltha O’Neal, Andre’Goodman, Dre’ Bly, Marcus Trufant... and keep reading from a list of 64 names. Assuming that she keeps responding in the negative, I would finally stop after 15 to 20 names, and then put the entire list up in chart form, showing their names, ages, and annual salaries.
“Ms. Sotomayor, these are the starting cornerbacks for the 32 NFL teams. There are two per team, for a total of 64. Do you see what their average age and income is? Would you say that a million plus per year is a good salary for a 25 year-old? Since you did not recognize any of the 64 names, would it surprise you to learn that all 64 of them are African-American? And, should any of them get injured in a game, I would add that each and every one of their replacements is also an African-American.
Now, Ms. Sotomayor, since blacks make up about 12% of the population of the United States, does it disturb you that blacks make up 100% of the people who have been given these lucrative contracts? What would you, as a sitting Supreme Court justice, do to alleviate this obviously unfair situation?”
Whyizzit that the media question now is one asking if Republicans will be hurt if they oppose the hispanic nomination when that wasn’t an issue for the Democrats when they were beating the crap out of Alberto Gonzales?
Why do you find racism acceptable, depending upon which race is discriminated against?
Why, as a Constitutional law judge, do you fail to use the Constitution as the basis for your decisions?
What, exactly, makes a latino female a better judge than a white male, or anyone of any race and/or gender, for that matter?
Why is it that you have no empathy for an disabled white firefighter, Ricci, who brought the New Haven suit after he overcame his dyslexia to score well on his promotion exam, only to have the courts slap him down because no blacks scored as well as he did?
