President Barack Obamas nominee to fill a Supreme Court vacancy was one of a trio of appeals judges who last year rejected the First Amendment claim of a Burlington student penalized by school administrators for using foul langauge in a blog she wrote at home.
Some observers said Wednesday the case presents a solid rationale for rejecting Judge Sonia Sotomayor of New Yorks Second Circuit Court of Appeals to fill the seat of retiring Justice David Souter.

Sotomayor’s decision is consistant with her 2nd amendment decision - states aren’t subject to the freedom of speech amendment.
Are there any opinions written by Sotomayor that the Left are holding up as an example of how intellectually superior she is?
None that I've heard of. Indeed, Jonathan Turley, a highly regarded lib law professor, stated on MSNBC (!!!) that he regards her as lacking in intellectual depth. In other words, she's an AA hack who shouldn't even be on the bench.
Originally, states weren’t covered by the First Amendment at all. Read it. The first word is “Congress”, defining who it applies to. That said, the Second Amendment has no such qualification.
