[There was a case ] a few miles away where a young father and firefighter Eddie Ramos died after a truss roof collapsed in a warehouse fire because the person who commanded the scene decided to send men into an unoccupied house, with no people to save on Thanksgiving Day, with a truss roof known to collapse early in the fire [...]

Then Judge Sotomayor interrupts:

JUDGE SOTOMAYOR: Counsel ... we're not suggesting that unqualified people be hired. The city's not suggesting that. All right? But there is a difference between where you score on the test and how many openings you have. And to the extent that there's an adverse impact on one group over the other, so that the first seven who are going to be hired only because of the vagrancies [sic] of the vacancies at that moment, not because you're unqualified--the pass rate is the pass rate--all right? But if your test is always going to put a certain group at the bottom of the pass rate so they're never ever going to be promoted, and there is a fair test that could be devised that measures knowledge in a more substantive way, then why shouldn't the city have an opportunity to try and look and see if it can develop that?

KAREN LEE TORRE: Because they already developed it, your honor.

JUDGE SOTOMAYOR: It assumes the answer. It assumes the answer which is that, um, the test is valid because we say it's valid.

KAREN LEE TORRE: The testing consultant said it was valid. He told them it was valid.... They had evidence that the test was job-related and valid for use under Title VII.

This woman is a racist, pure and simple. She would demand that New Haven keep doing it over and over until she gets the racial outcome she wants, an outcome that relegates the hated whites to permanent second class status. Her nomination makes a mockery of the idea of equal justice under the law. Why should white people stand for a regime that boldly and openly discriminates against them?

Pretty powerful stuff. She pretty much assumes that if she doesn’t like the result of the test (in terms of who passed), then the test must be at fault. Where’s the evidence that the test was keeping minorities down?

imagine if the races were reverse. The “wrong skin” color passes the test and wins the promotion. In order to not hire the “wrong skin” color, the promotion is cancelled. Nobody promoted so no discrimination.

That has to have been litigated.

The test was race neutral, stated by experts as race neutral and yet since the result was not quota reinforcing they tossed it.

ON TOP OF THAT other judges ripped her a new one for dishonest behavior in trying to conceal her dubious ethical conduct.

WHY IS THERE NO JUDICIAL COMPLAINT AGAINST THIS WOMAN?

Sotomajor is Puerto Rican, an American territory since 1898. Blame Teddy Roosevelt.

I'm a long-time supporter of Puerto Rican Independence. They have their own 500 year old culture. They speak Spanish. And they're on a island hundreds of miles from the US mainland.

Or maybe a substantive way would be to give the answers to the people that are supposed be hired, vagrancly speaking. Sic? Getting worse every day....

Pretty soon algebra tests will be essay form and graded on richness of experience.

Are you kidding? The Republicans will be falling all over themselves to ensure that everyone in the media loves them. The Democrats, with their long winded speaches fawning all over her will be more critical than the republicans in the Senate.

My error was not making clear that Sotomayor’s membership in “LaRaza” supersedes her rich and honorable Puerto Rican heritage.

How come the MCAT or other MAJOR tests LIKE the Bar Exam are not held in question in the same manner?? Maybe these too are prejudiced exams, yes?? sarc!

Is there a firefighter test on which whites and Hispanics do not, on average, outscore blacks? I would hazard a guess that no one has succeeded in developing such a test.

This pattern exists throughout the testing universe, whether it is SATs, LSATs, MCATS, whatever ... you name it. It is reality and cannot be wished away by the judiciary.

This is not to say that there are no blacks who can score in the upper ranges. It just didnt happen in this case.
