Liberals can do whatever they want to do. However, the Supreme Court does not have to take the case. It can be rejected with a written notice that its settled law. This particular argument is not settled law (whether the 2nd amendment falls under the incorporation clause of the 14th amendment). Common sense tells us what the answer is, but it's better to get it on the books as settled law now before someone's health goes poorly.
