Maybe Sarah resigned her Governorship because she knows someting we don’t? It sure would make the transition easier for AK and for her.

Incorrect. Under no alternative does Sarah Palin become Vice-President. Joe Biden is legitimately the Vice-President, having been properly elected to that position by the Electoral College.

The only question remaining would be whether the Presidential election would have to be re-adjudicated (in which case, McCain becomes the only eligible option and must be elected by the House) or whether the position is vacant, in which case Biden succeeds the vacancy. There is no law or precedent to declare either way, and the most politically expedient solution therefore would be for Biden to become President.

Nope. The electoral college holds two separate and independent elections for POTUS and VPOTUS and arenot bound to elect by ticket. Theoretically, the Electoral College could have given us Obama/Palin or McCain/Biden. Biden is the legitimately elected VPOTUS, and unlike his running mate, is Constitutionally eligible for the office.

I don't have my copy of the U.S. Constitution with me, but the Congress did certify the Electors. That would mean that the election is over and in the books in my view.

BUT...Running for an office to which you are constitutionally ineligible would quite likely be seen by most citizens as fraud. Then impeachment for that high crime would seem to be the recourse.

Check the Constitution. It doesn't work like that. Joe Biden will become President until a special election is held.

Biden will be impeached and on federal trial for multiple counts of fraud (campaign fund raising).

The reality is that SanFranNan will would finish out Opossum's term.

I don't think it would work that way. Where is the rule which says the second place finisher gets the prize in an election if the first place finisher is disqualified? More likely Nancy Pelosi would be President (ugh). Whether or not there would be a re-election or the four year cycle is cast in stone would be the next item of contention.

Nope, it wouldn't work that way. IF 0 can be removed, and IF the majority of congress can be convinced the 25th amendment doesn't apply; then only new elections will solve the crisis.
The results for that are anybody’s guess; mine is Hilliary, if the American people are still intoxicated by the KoolAid; and Sarah, if they've had enough!

Joseph Biden, natural-born US citizen, (well) over 35 years of age, inhabitant of Delaware for the past 14 years, received the votes of 365 properly chosen Electors for Vice-President of the United States, and these votes were properly counted by a special Joint Session of Congress on January 5, 2009 with Richard Cheney of Wyoming in the chair. Biden's election as Vice-President of the United States was then certified by that session, and signed by Cheney.

His election as Vice President has NOTHING TO DO WITH OBAMA, and if Obama is no longer President, Biden will assume the office.

If it would not be McCain and Palin, the only other person who could even become President would be the President Pro Tempore of the US Senate and that is Robert KKKKKKK Byrd.

Nancy Pelosi, would be ineligible because she would be up for perjury, due to signing an improper for stating that Barry is ineligible.

I’m not sure that will be true. I think Biden will be President, and there will be discussions about when the next election for POTUS will be, 2010 or 2012.

There may have been some thinking that if they could keep the lid on this until the end of 2009, then even if this was proven, they could go until 2012 with Biden as President.

Every time the guy opens his mouth, it really is amazing how bad Biden is in terms of ability to form cogent thoughts and communicate them. Yesterday’s speech was a doozy among a lot of bad speeches.

No, if Obama isn't eligible, the Electoral College would have to meet again and "chuse" someone the way they used to do it in the Federal Period. No committed electors (except those for McCain), just round after round of balloting until a new president is chosen.

Hell, they could elect Sarah. Or Hillary. Or Joe the Plumber. When the Electors meet without pledges, all bets are off, man.
