Rick Perry just stated on Mark Davis' show that Texas may use the 10th Amendment to reject Obamacare.

I'm relatively sure Perry is speaking in terms of ideas and not about any plans or upcoming legislative action.

Remember that he was the subject of a media attack when he suggested back in April that Texas could constitutionally secede from the Union.

That said, I would be in favor of Texas taking such action based upon the 10th Amendment.

Remember politicians never change and Rick Perry’s strategy to win the governor election is to be the “Right” of RINO Kay Bailey Hutchinson.

I believe that since federal power/law falls directly upon the individual and not the States, the only effect the State could have is in refusing to participate in implementation. Usually State implementation is purchased as part of a program with financial strings. That means the State has to be willing to forgo the money that will come along with the program - most likely affecting the Medi-Cal/Medicaid program and other health money from the feds.

The feds will still require the individuals and businesses to participate. (The State can do nothing about that unless it participates in a lawsuit challenging constitutionality of the federal program brought by some individual/business with a substantive interest.)

Whatever the reason, Perry will be a much better governor than Kay Bailey. Warts and all. If the race was between Perry and Cornyn, that would be a whole different story. Go (away) Kay Bailey.
