Sec. 204.005. VACANCY FILLED AT SPECIAL ELECTION. If a vacancy occurs during an odd-numbered year or after the 62nd day before general primary election day in an even-numbered year, the remainder of the unexpired term shall be filled by a special election in the same manner as provided by Chapter 203 for the legislature, except that:

(1) the minimum number of signatures that must appear on a petition accompanying a candidate’s application for a place on the ballot is 5,000; and

(2) Section 203.013 does not apply.

I think that Sections 204.003, 204.004 and 204.005 are meant to determine whether the remainder of a vacant 6-year term will be filled at either a special election [no primary process] or via the general election/primary process.

In any event, if there is a vacancy, we will have a time from the resignation until the appropriate election where the Gov will appoint a senator pursuant to Section 204.002. Section 204.002 is written such that Texas will always have 2 Senators in Congress.

So, for example, say KBH resigns, and the statutes say we will have a special election. The seats will be filled as follows:

1. Gov appointee until the special election
2. Special election to fill the remaining stub term
3. Regular general election when the next 6-year term election comes up
