3 Sentenced to Prison for Illegally Exporting Highly Sensitive U.S. Technology to China

LOS ANGELES—In two separate cases, three men have been sentenced to federal prison for attempting to transport sensitive and advanced U.S. technology to the People's Republic of China (PRC). Two men were sentenced yesterday, and another man linked to one of the schemes was sentenced last week to five years in prison.

William Chi-Wai Tsu, 61, a Beijing resident, was sentenced yesterday to 40 months imprisonment for his role in exporting high-tech integrated circuits with military applications to the PRC.

In a separate case, Tah Wei Chao, 53, of Beijing, was sentenced yesterday to 20 months imprisonment after pleading guilty to attempting to smuggle 10 highly sensitive and advanced thermal-imaging cameras to China. Chao's co-defendant Zhi Yong Guo, 50, also of Beijing, was sentenced on July 27 to five years in federal prison for his involvement in the thermal-imaging cameras scheme.

All three defendants were sentenced by U.S. District Judge John F. Walter. The defendants in the two cases were charged under the International Emergency Economic Powers Act (IEEPA) and Export Administration Regulations (EAR) for procuring and illegal exporting sensitive technology in violation of United States export laws.

In the case involving the integrated circuits, Tsu, who was vice president of a Hacienda Heights company called Cheerway Trading, illegally shipped more than 400 sophisticated integrated circuits to China, according to court documents. Tsu was arrested on Jan. 10, 2009, and he pleaded guilty to two felony counts of March 13, 2009. Investigators said the thumbnail-size circuits that were shipped out of the country have a variety of potential applications, including use in sophisticated communications and military radar systems.

Prosecutors argued in a sentencing brief that Cheerway was nothing more than a front company that Tsu used to ship items to his Beijing-based company called Dimagit Science & Technology Co. Ltd. According to the sentencing brief, Dimagit's catalog was imprinted with images of military craft and clearly explained Tsu's business: "to facilitate the building of the national defense of China" and to "revitalize the Chinese military industry."

Prosecutors also argued that Tsu supplied restricted U.S. technology to several customers in China, including the "704 Research Institute," which is known as the "Aerospace Long March Rocket Technology Company" and is affiliated with the state-owned China Aerospace Science & Technology Corporation.

Tsu was indicted on federal charges on February 6, 2009 and he pleaded guilty to two federal counts on March 13, 2009.

In the case involving the thermal-imaging cameras, Chao and Guo were arrested at Los Angeles International Airport on April 4, 2008 while attempting to board an international flight to China with 10 thermal-imaging cameras secreted in their luggage. The cameras, which were manufactured by FLIR Systems, Inc. and cost more than $5,000 each, were stuffed inside the defendants' shoes and concealed in their clothes.

The cameras, which are contained in two-inch cubes, are so sensitive that they can perceive a heat source on an object that is not visible to the naked human eye. In addition, the cameras can perceive the residual heat source image on an object long after the heat source has been removed. These cameras, according to the manufacturer, have a wide range of military, law enforcement and civilian applications.

Chao and Guo were indicted on federal charges on April 18, 2008. Ten days later, Chao pleaded guilty to three federal counts. In February, following a one-week jury trial, Guo was convicted of two federal counts.

Under IEEPA and EAR, the United States bars the export of sensitive technology and equipment to certain countries. The integrated circuits and the thermal-imaging cameras involved in these two cases are considered "dual-use" items, meaning they have potential military applications, as well as non-military uses. As such, their export to China is strictly controlled and would require advance permission from the U.S. Department of Commerce.

These two cases were investigated by the Export and Anti-proliferation Global Law Enforcement (EAGLE) Task Force. The counter-proliferation task force was created by the United States Attorney's Office for the Central District of California, in conjunction with federal law enforcement agencies, to jointly investigate and combat the illegal exports of arms and sensitive technologies.

Members of the EAGLE Task Force include the U.S. Department of Commerce, Bureau of Industry and Security, Office of Export and Enforcement; U.S. Immigration and Customs Enforcement (ICE); the Federal Bureau of Investigation; Defense Criminal Investigative Service; U.S. Customs and Border Protection; the Diplomatic Security Service and the Transportation Security Administration.

Forty months, 20 months and five years for stealing technology that cost millions to develop, that can be used for weapons, and turning it over to the adversary? How’s about shooting them at sunrise? Slaps on the wrist, that will do nothing to prevent or discourage this from happening again.

CHINA WILL LIKELY replace the USA as world leader, said Bill Clinton in a recent Washington Post interview. It is just a matter of time. Clinton should know. He has personally done more to build China’s military strength than any man on earth.

Most Americans have heard of the so-called "Chinagate " scandal. Few understand its deadly import, however. Web sites such as "Chinagate for Dummies" and its companion "More Chinagate for Dummies" offer some assistance. Unfortunately, with a combined total of nearly 8,000 words, these two sites – like so many others of the genre – offer more detail than most of us "dummies" can absorb.

For that reason, in the 600 words left in this column, I will try to craft my own "Idiot’s Guide to Chinagate," dedicated to all those busy folks like you and me whose attention span tends to peter out after about 750 words. Here goes.

When Bill Clinton took office in 1993, China presented little threat to the United States. Chinese missiles "couldn’t hit the side of a barn," notes Timothy W. Maier of Insight magazine. Few could reach North America and those that made it would likely miss their targets.

Thanks to Bill Clinton, China can now hit any city in the USA, using state-of-the-art, solid-fueled missiles with dead-accurate, computerized guidance systems and multiple warheads.

China probably has suitcase nukes as well. These enable China to strike by proxy – equipping nuclear-armed terrorists to do their dirty work, while the Chinese play innocent. Some intelligence sources claim that China maintains secret stockpiles of chemical, biological and nuclear weapons on U.S. soil, for just such contingencies.

In 1997, Clinton allowed China to take over the Panama Canal. The Chinese company Hutchison Whampoa leased the ports of Cristobal and Balboa, on the east and west openings of the canal respectively, thus controlling access both ways. A public outcry stopped Clinton in 1998 from leasing California’s Long Beach Naval Yard to the Chinese firm COSCO. Even so, China can now strike U.S. targets easily from their bases in Panama, Vancouver and the Bahamas.

How did China catch up so fast? Easy. We sold them all the technology they needed – or handed it over for free. Neither neglect nor carelessness are to blame. Bill Clinton did it on purpose.

As a globalist, Clinton promotes "multipolarity" – the doctrine that no country (such as the USA) should be allowed to gain decisive advantage over others.

To this end, Clinton appointed anti-nuclear activist Hazel O’Leary to head the Department of Energy. O’Leary set to work "leveling the playing field," as she put it, by giving away our nuclear secrets. She declassified 11 million pages of data on U.S. nuclear weapons and loosened up security at weapons labs.

Federal investigators [Cox Report] later concluded that China made off with the "crown jewels" of our nuclear weapons research under Clinton’s open-door policy – probably including design specifications for suitcase nukes. Meanwhile, Clinton and his corporate cronies raked in millions.

In his book The China Threat, Washington Times correspondent Bill Gertz describes how the system worked. Defense contractors eager to sell technology to China poured millions of dollars into Clinton’s campaign. In return, Clinton called off the dogs.

Janet Reno and other counterintelligence officials stood down while Lockheed Martin, Hughes Electronics, Loral Space & Communications and other U.S. companies helped China modernize its nuclear strike force.

Clinton’s top campaign contributors for 1992 were Chinese agents; his top donors in 1996 were U.S. defense contractors selling missile technology to China.

Clinton recieved funding directly from known or suspected Chinese intelligence agents, among them James and Mochtar Riady who own the Indonesian Lippo Group; John Huang; Charlie Trie; Ted Sioeng; Maria Hsia; Wang Jun and others.

Commerce Secretary Ron Brown served as Clinton’s front man in many Chinagate deals. When investigators began probing Brown’s Lippo Group and Chinagate connections, Brown died suddenly in a suspicious April 1996 plane crash.

Needless to say, China does not share Clinton’s enthusiasm for globalism or multipolarity. The Chinese look out for Number One.

"War [with the United States] is inevitable; we cannot avoid it," said Chinese Defense Minister General Chi Haotian in 2000. "The issue is that the Chinese armed forces must control the initiative in this war." Bill Clinton has given them a good start.

WASHINGTON, March 26 (UPI) -- The continuing tensions over Russia's refusal to sell its state-of-the-art land warfare advanced weapons systems to China hasn't interrupted the rhythm of major joint military exercises between the two major land powers on the Eurasian landmass. The latest in the regular, biennial series of exercises between the two nations has been confirmed for this summer.

The next in the now well-established series of exercises called Peace Mission 2009 will be carried out in northeastern China, the Russian Defense Ministry announced March 18, according to a report carried by the RIA Novosti news agency.

The first bilateral Peace Mission maneuvers -- described at the time as counter-terrorism exercises -- were held in Russia and the eastern Chinese province of Shandong in August 2005. As we reported at that time, they were a lot bigger than mere counter-terrorism exercises. Warships, squadrons of combat aircraft and more than 10,000 troops were involved carrying out landings against hypothetically hostile shores. The maneuvers also involved large-scale paratroops drops. The scale and nature of those exercises suggested a trial run for a possible Chinese invasion of Taiwan with Russian support. ..."

Russia, China flex muscles in joint war games

CHEBARKUL, Russia (Reuters) - Russia and China staged their biggest joint exercises on Friday but denied this show of military prowess could lead to the formation of a counterweight to NATO.

"Today's exercises are another step towards strengthening the relations between our countries, a step towards strengthening international peace and security, and first and foremost, the security of our peoples," Putin said.

Fighter jets swooped overhead, commandos jumped from helicopters on to rooftops and the boom of artillery shells shook the firing range in Russia's Ural mountains as two of the largest armies in the world were put through their paces.

The exercises take place against a backdrop of mounting rivalry between the West, and Russia and China for influence over Central Asia, a strategic region that has huge oil, gas and mineral resources.

Russia's growing assertiveness is also causing jitters in the West. Putin announced at the firing range that Russia was resuming Soviet-era sorties by its strategic bomber aircraft near NATO airspace.

War Games: Russia, China Grow Alliance

In foreign policy it’s critical to “know thine enemy.” So American policymakers should be aware that Russia and China are inching closer to identifying a common enemy — the United States.

The two would-be superpowers held unprecedented joint military exercises Aug. 18-25. Soothingly named “Peace Mission 2005,” the drills took place on the Shandong peninsula on the Yellow Sea, and included nearly 10,000 troops. Russian long-range bombers, the army, navy, air force, marine, airborne and logistics units from both countries were also involved.

Moscow and Beijing claim the maneuvers were aimed at combating terrorism, extremism and separatism (the last a veiled reference to Taiwan), but it’s clear they were an attempt to counter-balance American military might.

There won’t be many secrets kept in the future. We have allowed so much immigration from so many nations that most every type sensitive job is being held by immigrants from friendly and not so friendly nations. Nations have always used the immigration and legal resident route to insert their spies and industrial espionage agents.

An indication of just how deep and subtle Red Chinese roots run in U.S. business and government affairs deals with McCain and Kerry. Both McCain and Kerry fought long and hard to provide the political cover Clinton needed when he made the controversial decision to normalize relations with Vietnam. McCain’s wife, Cindy, is the daughter of James Hensley, who is the second largest Anheuser-Busch distributor in the United States. McCain is an officer in Hensley & Co. and Cindy is a vice president. The McCain family owns several million dollars in Anheuser-Busch stock. Frances Zwenig, John Kerry’s (D-MA) chief of Staff for the now defunct Senate Select Committee on POW/MIAs, was given a position at Commerce in the Vietnam Interests Section until some genius decided it may be a conflict of interest. Kerry’s cousin, C. Stewart Forbes, is CEO of Colliers International, real estate.

In Dec. 1992, Vietnam granted Colliers a contract designating Colliers the “exclusive real estate agent representing Vietnam.” Colliers has since written contracts in Vietnam worth billions, upgrading Vietnam’s ports, railroads, highways and government buildings.

Colliers is involved with Lippo in multimillion contracts in Indonesia. Kerry, who has a blind trust run by members of his family, claims he knows nothing about his cousin’s business deals or affiliations.

Lifting the embargo opened the door for the multi-billion dollar corporation, Lippo Group with American business partners, such as Stephens Investment of Little Rock, AR to conduct business in Vietnam. Mr A. Vernon Weaver, at that time the Vice-President for Operations in the Pacific Rim of Stephens Investment and a member of the Board of Visitors at the U.S. Naval Academy was instrumental in arranging an upgrade of the position of Commandant of the U.S. Naval Academy from two stars to four stars.

October 12, 2000 Riady Invites Clinton to Lippo Board Indonesian tycoon James Riady has invited U.S. President Bill Clinton to join the board of Lippo Group when he steps down from office early next year, according to business people who have met Riady in Jakarta recently. Riady has been telling business contacts in Jakarta that he expects Clinton to accept, even though the U.S. president has been dogged by allegations that Riady funnelled illegal foreign donations to Clinton’s 1992 and 1996 election campaigns. A former Lippo Group employee reports that as far back as the mid-1990’s Riady was said to be trying to recruit Clinton to the board as soon as he left office. Jakarta police are currently helping the U.S. Justice Department in its investigation of the alleged campaign contributions.

Lippo Group

* The Lippo Group made consulting payments to Webb Hubbell totaling between $100,000 and $250,000 after Hubbell had promised to cooperate with Whitewater investigators. Hubbell did not cooperate and no recommendation for leniency was made at his sentencing. (5)

James Riady

* Riady has donated over $475,000 to the DNC, Clinton Inaugural Fund, and related Democratic candidates. An August 1992 memo to Bill Clinton says Riady “will be giving $100,000 to this event and has the potential to give much more.”(3)

* Bank statements, memos, and checks show that one of Riady’s 1992 donations was directly covered by foreign funds and the rest came from a personal bank account that appears to have received foreign money before and after donations were made.(3)

Sonaya & Arief Wiriadinata

* Illegally contributed $450,000 to the DNC.(8)

* Arief is heard on videotape (at a White House coffee) telling Bill Clinton, “James Riady sent me.”(4)

John Huang

* Has raised over $3.4 million for the DNC, approximately half of which, has been returned.(4)

* At a 1996 Los Angeles fund raiser, Bill Clinton said, “I’d like to thank my long time friend, John Huang, for being so effective. Frankly, he’s been so effective, I was amazed that you were all cheering for him tonight after he’s been around in his aggressive efforts to help our cause.”(4)

What They Got:

Lippo Group

* The Lippo Group has investments in the coal mining industry in Indonesia. The leading export of Indonesia is a new form of clean burning, low sulfur coal. This is the only type of coal that meets the U.S. Clean Air Standards Act.(6)

* The largest known deposit in the world of this coal is located in Southern Utah.(6)

* The coal in Utah was slated to be mined when Bill Clinton declared 1.7 million acres in Southern Utah as the “Grand Escalante National Momument.” This declaration made the coal mining project infeasible and locked up over a trillion dollars worth of this coal. (6)

* Bill Clinton never discussed his decision with Congress , Utah officials, or the Democratic Congressman who represented this district until the midnight before the declaration was made.(7)

* The head of the Council of Environmental Quality (Kathleen McGinty) stated in an email that the lands were “not really endangered.” The associate director (Linda Lance) stated in an email that the lands were “not threatened.”(6)

* The surrounding 29 Utah counties have filed suit to overturn Clinton’s declaration.(6)

James Riady

* James Riady was an occasional visitor to the White House and had direct access to Bill Clinton.(3)

* Clinton spokes people told reporters that visits with James Riady were “social visits.” A videotape of a July 1996 dinner for James Riady shows Bill Clinton discussing the deployment of U.S. aircraft carriers to the Taiwan Strait.(4)

John Huang

* Huang was hired at the Commerce Dept. in 1994. His supervisor (Jeff Garten) testified, “He was totally unqualified.”(1)

* When Huang left the Lippo Group for the Commerce Department, he was paid a $780,000 bonus by Lippo.(1)

* Huang received Top Secret Security Clearance before, during, and after his tenure at Commerce.(1)

* According to a memo dated January 31, 1994, the chief of security at Commerce (Paul Buskirk) granted Huang “a waiver of background investigation.”(2)

* While at the Commerce Dept. Huang received intelligence briefings from the CIA, had access to top secret reports, visited the White House at least 67 times, and met with Bill Clinton at least 15 times.(2)

* According to telephone records, Huang made at least 261 phone calls to Lippo Group offices during his tenure at Commerce.(2)

* Huang received 37 classified briefings on China and Vietnam from the CIA. According to the testimony of a CIA officer John Dickerson, Huang had access to “extremely sensitive sources.”(1)

Obstruction / Cover Up:

* In March of 1997, the House Resources Committee requested documents detailing President Clinton’s decision to designate the 1.7 million acres in southern Utah as the Grand Escalante National Monument. The White House supplied over 100 documents and withheld 27. The House Committee subpoenaed the 27 withheld documents and they were produced on October 22, 1997. (7)

* James Riady has left the country.(4)

* Sonaya & Arief Wiriadinata have left the country.(4)

* John Huang is pleading the Fifth Ammendment.(4)

* Attorney General Janet Reno (Clinton appointee) heads the Justice Department, which is responsible for investigating campaign finance violations. The head of the FBI, (Louis Freeh, Clinton appointee) and the lead investigator (Charles LaBella) have recommended the appointment of an independent counsel to investigate this matter. As of July 1998, Janet Reno refuses to appoint an independent counsel.(10)

It really saddens me that SOME Chinese people risk US/China relations by stealing technology. Don't they realize, that China is developing their own technology. And that someday, maybe in 50 years, that it will the Americans smuggling Chinese technology out of China.

That 1977 Clint Eastwood movie "Firefox" where he goes into the former USSR to steal a sophisticated Soviet fighter makes me laugh. It just isn't realistic....but makes for a good Hollywood movie.

However, in 50 years time, I do believe a scenario where an American will steal Chinese technology could possibly happen. That, is a very believable scenario (of course, I doubt Hollywood will ever make a movie like that). BTW, my comments aren't meant to incite, but I do honestly feel that my projection about China is a more realistic scenario than what is portrayed in Firefox in regards to the former USSR.
