You may recall that here in The People's Republic of New Jersey, a few years back, the hard-left leaning Supreme Court said that it was okay to replace the democrat candidate for the U.S. Senate (Toricelli, who was caught red-handed in a bribery scandal that was too disgusting for even the NJ voters to stomach) despite the fact that such replacement so close to the election was strictly forbidden by the laws of the state. The substitution needed to have been made by the statutory deadline and it had long since passed. Torricelli was tanking badly in the polls and his defeat was a foregone conclusion. So Torricelli was encouraged (threatened? bribed some more??) to resign, leaving this very blue state without a democrat candidate on the ballot. The Court, in its "infinite wisdom," ruled that the voters were entitled to a "choice" in the election (there actually was a viable third-party candidate, along with the republican), and chose to ignore the very law they were charged to uphold. The rest is history. Old-timer Frank Lautenberg (or a reasonable body-double) was allowed to run in place of The Torch, and the morons in my home state voted for him in a landslide.
One thing is obvious: liberals see The Constitution and the rule of law as impediments to be overcome in pursuit of their socialist agenda. Conservatives see The Constitution and the rule of law as the very framework and foundation of our government, and they must be respected at all costs, despite the political ramifications. It's the difference between Justice Roberts and Sotomayor.
I want to see the note. Is it signed?
I wouldn’t put it past the Democrats to put his corpse on ice and get a few months worth of “dying wishes” out of him before thawing him out for his funeral.

In a note to Gov. Deval Patrick and other state leaders, Kennedy asked that lawmakers allow the governor to appoint an interim replacement pending election of a successor, to ensure there would not be a period with a vacancy. Currently, the law requires a special election to be held within five months.

I thought that it was ridiculous that the Democrats stripped the governor’s power to name temporary Senators just because a Republican was in power, but I think that Kennedy is correct that a state should have two Senators at all times, and thus I would support the law being changed back to what it was (and not to something unconstitutional that places restrictions on who the governor can name).
Of course, if Kennedy’s illness is so serious as to not allow him to perform his duties, the same arguments he has made regarding how Massachusetts should always have two Senators would be arguments in favor of announcing his resignation (to be effective the sooner of when his replacement is elected in a special election or, if they changed the law, named by the governor).

Trust me, he didn’t “write” and didn’t dictate this letter. I know a little about glioblastoma brain tumors. Either he is a walking miracle with a brain tumor or somebody is lying. I have had two family members and three friends die of this brain caner. 60% of those diagnosed die within the first year. Those remaining undergo regular chemotherapy, using implanted wafers in the brain area. They additionally have at least two removals of cancer tissue called resectioning. These are all very invasive surgeries and cause damage. Starting from the diagnosis and first biopsy it was a steady decline to incoherent speech, inability to read or write, paralysis, etc. They spent the last six months of their lives not being able to really communicate.
Funny, I didn’t notice your name until I went to post my comment which is “I’m a Massachusetts voter with “Kennedy Fatigue”. One poster wrote that Kennedy has been in office since 1962, which made me a small child when he was elected. All I can say is shame on us Bay Staters. . .
He is trying to get the 60 votes needed to stop a filibusterer on a Health Care Bill. Simple.

Someone on my facebook, when I pointed out Ted has missed 270 votes, said we need “two voices” (votes). I replied, what if Ted lingers on for 5 more months? Five more months of MA only having one vote.
And how about 2003-04 when Kerry was running for Pres. He missed a lot of votes too, due to that.
Ah but the health care issue is important, so...
