That would be a tough order to follow for afterward the poor pilots could only say for the rest of their lives, like they did at Nuremberg, “but we were only following orders.”

Flying warplanes into a sovereign country's airspace is an act of war. That's why you need to ask permission/have a treaty.

But without certainty that the CIC is constitutionally qualified to hold the office, they can't even say they were sure they were lawful orders...

I'd prefer it if we shot Zbigniew.

That's a much more probable scenario than shooting down Israeli fighter jets. Something the CIA could take care of quietly, with no fallout other than some crazy-sounding comment from the reliably crazy-sounding Jimmy Carter. Just imagine if the CIA did this, and Carter jumped in front of the TV cameras saying "I believe the CIA did this". The whole world would roll its eyes and then carry on as usual.
