SNIPPET: “The lawsuit alleging negligence by the government said that the Defense Department is avoiding legal and financial responsibility for the killings by referring to the shootings as “workplace violence” rather than as a terrorist attack.
The group also is suing the estate of Anwar al-Awlaki, a radical U.S.-born Islamic cleric who the victims say inspired the Army psychiatrist, Maj. Nidal Hasan, to carry out the attack. The two men exchanged emails before the shootings.”

The new judge in the Fort Hood shooting rampage case faces a controversial decision next week: whether to spare Nidal Hasan a possible death sentence and let him plead guilty in the worst mass shooting on a U.S. military installation.
Hasan wants to plead guilty to 13 counts of premeditated murder, Army rules prohibit a judge from accepting a guilty plea in a death penalty case...

SNIPPET: “Army psychiatrist Nidal Malik Hasan said twice this week that he waged the 2009 Fort Hood shooting massacre to defend “others” from his fellow soldiers. Those others, he said during a hearing Tuesday, were “The leadership of the Islamic Emirate of Afghanistan, the Taliban.”
Hasan plans to represent himself during his pending murder trial in military court, using a defense that says he acted in “defense of others.” Despite his own statement, and detailed records showing he communicated with American-born al-Qaida cleric Anwar al-Awlaki before the attack, the government considers the attack a form of “workplace violence” rather than terrorism.
The attack killed 13 people and wounded 30 more. Because of the “workplace violence” designation, victims will not receive Purple Hearts and survivors have not received combat benefits. U.S. Rep. Frank Wolf, R-Va., has sponsored an amendment to an appropriations bill to change that. Hasan, meanwhile, remains in the Army pending his trial. He has received $278,000 in pay since the Fort Hood attack.
In addition to being denied benefits, survivors may now have to face Hasan if they are called to testify at his trial.”

On December 7, 1941, the U.S. naval base at Pearl Harbor was attacked. Three years, eight months, and eight days later, the Japanese surrendered. These days, America’s military moves at a more leisurely pace. On November 5, 2009, another U.S. base, Fort Hood, was attacked — by one man standing on a table, screaming “Allahu akbar!” and opening fire. Three years, nine months, and one day later, his court-martial finally got under way.
The intervening third-of-a-decade-and-more has apparently been taken up by such vital legal questions as the fullness of beard Major Hasan is permitted to sport in court. This is not a joke: See “Judge Ousted in Fort Hood Shooting Case amid Beard Debacle” (CBS News). Army regulations require soldiers to be clean-shaven. The judge, Colonel Gregory Gross, ruled Hasan’s beard in contempt, fined him $1,000, and said he would be forcibly shaved if he showed up that hirsute next time. At which point Hasan went to the U.S. Court of Appeals for the Armed Forces, which ruled that Colonel Gross’s pogonophobia raised questions about his impartiality, and removed him. He’s the first judge in the history of American jurisprudence to be kicked off a trial because of a “beard debacle.” The new judge, Colonel Tara Osborn, agreed that Hasan’s beard was a violation of regulations, but “said she won’t hold it against him.”
The U.S. Army seems disinclined to hold anything against him, especially the 13 corpses plus an unborn baby. Major Hasan fired his lawyers, presumably because they were trying to get him off — on the grounds that he’d had a Twinkie beforehand, or his beard don’t fit so you must acquit, or some such. As a self-respecting jihadist, Major Hasan quite reasonably resented being portrayed as just another all-American loon gone postal...
