Shep Smith just reporting that the scumbag will be tried in military court

When W was gov there was a big flap in Canada about some dirtbag Canadian who had killed some (1?) Texan and got the death penalty. A Canadian reporter said to him something like ... what can you say to reassure Canadians who are worried about the Texas death penalty.

W said something like don't kill anyone if you come here and you'll be OK. (I quote from memory)

But I can promise you there are a lot of po’d Texans who would have no problem with giving him entry into our court system.

I'd trust Texas. I'm trying to figure out (and I can't believe I'm saying this) whether we can trust the military bureaucracy to handle this traitor *as* a traitor who shed blood on our own soil.

It’s important that they levy terrorism charges. And terrorism charges make it flip to Federal court.

It's political. Obama does not want people to think that a major terrorist attack on American soil happened on his watch.

Does the fact that one of the deceased was a civilian change the jurisdiction? Or is this just a case where the Fed gets to decide what they want to do and the military is not the decider?

The Uniform Code of Military Justice (UCMJ) is a commander’s program.

Generals in the chain of command can halt a prosecution process at any time for any reason (and must approve all sentences).

It seems that the Commander in Chief would be able to disapprove any capital punishment. Then again, the President can always pardon or commute the sentence of anyone convicted of a federal crime.

But the beauty is that the State of Texas has jurisdiction to try a soldier who commits a crime in Texas, regardless of what the feds want to do - and it is NOT double jeopardy to try a soldier for violating a federal crime under the UCMJ by killing person A, and then try him under Texas law for killing person A.

It's a very sad discussion and it carries me to the old saw about "if you're going to shoot him, be sure that you kill him".
Maybe if the police lady hadn't been wounded herself....

I want to stress that I am not an expert. But I have been reading a lot of articles about whether Hasan will be tried by the military or the Federal governemtn.

I know.....what an amazing coincidence.
Hasan 1 had as many red flags as Hasan 2 .
It’s common sense to believe that there have to be others with the same ideology
that are being protected by the military in the name of diversity.
