DON STEWART, McCONNELL SPOKESMAN: Republicans have been trying to set up a meeting with Senate Democrats since yesterday to discuss this fatal point of order but have been met with nothing but silence. We suspect Democrats are slow walking us so as to have the House vote first. Since Senate Democrats refuse to meet with us and the Parliamentarian, weve informed our colleagues in the House that we believe the bill theyre now considering violates the clear language of Section 310g of the Congressional Budget Act, and the entire reconciliation bill is subject to a point of order and rejection in the Senate should it pass the House.
Exactly-Rush had this nailed ages ago. Now Obama has legit cover to not even discuss the house "fixes." I also refuse to believe Stupak is stupid enough to believe an Obama EO will ever hold up. Obama believes in partial birth killings.

He’s bringing up these various groups of House Democrats and saying, “Look, we’re not going to be able to get the public option. That’s not in the Senate bill. We can’t get it now. We’re going to build the foundation. It’s a first step.” So there isn’t going to be reconciliation.”
All this talk of getting the Senate bill passed in the House and then back to the Senate for reconciliation where all the things the House wants get added in, the second bill, a third bill, not going to happen. The point is it was never the intention. It’s all been a head feint from the get-go. Once the House passes the Senate bill we’ve got Obamacare.
I think it’s clear that Stupak and most of his group always intended to vote for this bill, they simply were determined to push the envelope as far as possible before smiling and claiming in front of the MSM that their “concerns” were met.
Of course, if we try it (and I'm taking this story with a grain of salt) it'll be characterized as a "parliamentary maneuver" and "trying to circumvent the will of the people" if not "trying to shred the Constitution."

As I read that, and Section 310, it's not only the Senate that can't take up the reconciliation bill. The House can't either. (obviously they will, but surely Mark Levin or someone will have a lawsuit ready challenging the House's passage of the reconciliation). |

When I called my dem Rep, I took a slightly different path, I asked what he was doing to guarantee that the changes being promised the house would occur in the senate and since there was nothing he could do, why would he vote for this bill?
The staffer hemmed and hawed and admitted that deem and pass was much more popular than the Senate bill. Lord knows what will happen, but I think they are more attached to their agenda.....
Ok, where is the GOP now? Why are they not on FOX explaining this to the public? Where are they?
Many Democrats in the House do not like the Senate bill (Cadillac tax, Nelson and Landrieu deals, etc.) and possibly would not vote yes on it unless they were assured the reconciliation package would pass the Senate. Harry Reid either met with or sent a letter to House Dems assuring them that he had the votes to pass reconciliation. He only needs 51 votes.
McConnell is saying that language in the reconciliation bill cannot be considered in the Senate because of House rules (don't understand the details but something to do with earmarks). If that is the case then what the House has to consider is if they can vote for the Senate bill with no guarantee of fixes.
What's even more delicious if this is the case is that if the House and Senate create another bill to fix the current one, it is subject to Senate filibuster rules, not just a 51 vote majority. So Scott Brown will become more important than ever. The House may very well never get the fixes they want.
