McCollum to file lawsuit against health care bill

ORLANDO, FL -- Moments after Congress voted to approve President Obama's health care legislation, Florida's Attorney General announced he will file a lawsuit to declare the bill unconstitutional.

Bill McCollum will join Attorneys General from South Carolina, Nebraska, Texas, Utah, Pennsylvania, Washington, North Dakota and South Dakota to file a lawsuit against the federal government.

"The health care reform legislation passed by the U. S. House of Representatives this evening clearly violates the U.S. Constitution and infringes on each state's sovereignty," McCollum said in a statement distributed late Sunday night.

"If the President signs this bill into law, we will file a lawsuit to protect the rights and the interests of American citizens."

McCollum will hold a press conference at his Orlando office Monday morning to discuss his plans.

GOD is in control, Rose.

We never should have faith in men. But we can ALWAYS have faith in the Lord.

I truly don't believe He has lifted His hand off of America yet.

The remnant here is strong, and we are in deep prayer.

DON'T GIVE UP!!

Well, PA is the only ‘rat run state that isn’t in deep fiscal doo-doo. It seems that at least at the state level, the ‘rats in PA are still a relatively sane center-left party.

Correction, the taxpayers will be forced to pay for those the government deems don’t have enough money to afford insurance, and the IRS will go after those the government deems can afford insurance but chose not to purchase it.

Just because they used a straight up or down vote doesn’t mean the deemin’ demons aren’t still at the heart of this thing.

Remember the AMT was supposed to target “the rich”, but plenty of us solidly middle class folk get hit with it (and even when we don’t have to fill out the d*mned extra forms to prove we don’t)? Same thing with this.

I’m willing to bet the cutoffs for the “cadillac tax” on high coverage health plans (defined by their cost not their benefits) are not indexed to inflation, and even if the are, it will only slightly delay the time when the increased cost of coverage created by this monstrosity push magically turn “chevy” employer provided health coverage into “cadillac” coverage.

It does trump state law, if its constitutional.

“Nothing is going to happen. The courts will simply dismiss it saying federal law trumps state law.

The fight is over.”
+++++++++++++

What about if 2/3 of the states convene a Constitutional Convention? And 3/4 of them ratify it?

http://www.usconstitution.net/constam.html

The Constitution, then, spells out four paths for an amendment:

Proposal by convention of states, ratification by state conventions (never used)

Proposal by convention of states, ratification by state legislatures (never used)

Proposal by Congress, ratification by state conventions (used once)

Proposal by Congress, ratification by state legislatures (used all other times)

“that at least at the state level, the ‘rats in PA are still a relatively sane center-left party.”

That may be the only place in the country. All others are certifiably INSANE. On both fiscal and social issues.

“The only way this will have any teeth, is if the states refuse to abide by it when the courts throw out the lawsuit.”

Right. This is the Constitutional battle/crisis that is setting up now. There are some VERY serious challenges that are and will go forward.

And with the RATS about to get SMACKED DOWN HARD IN 7 months.

“I wonder is George Soros willing to pay potentially hundreds of millions in legal fees trying to defend Reid, Pelosi, etc. from what could be so many lawsuits that the health care reform may never become law when it’s tied up in the courts for two to four years.”

Hope that SOB goes bankrupt. Something makes me think he’s hedged his $$ so he can fight again...(pun intended). Why does anyone that’s uber wealthy *want* socialism? - he must think he can ride around at the top of the hammer and sickle.

And he’s a naturalized citizen who made his money here. SICK!

Face it you are a defeatist or a plant. MCCain Feingold was shredded, Rostekowski was chased by seniors and the bill was repealed.

The cases would be dismissed due to lack of standing, and any court fees would be picked up by the American taxpayer.

I admire the sentiment here, but it just doesn’t work in the way you propose.

Ho do states not comply?

The Feds are going to take money directly from our paychecks for this.

Maybe states could give us a state income tax amount to use as a deduction against the federal taxes? Then, if everyone files with this state tax deduction, the Fed (Slave Master) cant single out a citizen (Slave). We need a massive revolt with protection of our states. I see a "Boris Yeltsin" emerging in our near future.

Jim Vicevich said this morning that Connecticut and New York are NOT onboard with a lawsuit against ObamaCare (surprise, surprise).

So how do we get out from under the mandates and other horrors of ObamaCare? Hope for a repeal?

For a "repeal" to happen, we MUST elect a Republican House, Senate AND President in 2012. Kind of a tall order...
