Let me tell you - if Ken Cuccinnelli wins this case - he should go to the front of the line in 2012 for the GOP. He is a real deal conservative.

Ken is a one of the brightest stars in the young Repubs in these recent elections. I also like Chris Christie.

absent a reply to your query from a lawyer, and with only such experience as I have peripherally with the courts, I believe the judges are chosen in a ‘random’ fashion. That’s what most courts are doing these days. The ‘judge shopping’ tends to be only at SCOTUS any more. It used to be at all federal levels.

The complaint is against HR 3590 which has been enrolled and signed by the President. What is HR 4872?

My sentiments exactly. Supposedly from one of the “first families of Va.”, I was living out of state for years and couldn’t believe Va. went down the RAT hole. Now that Virginia seems to be coming to their senses, it’s good to be back here in Richmond. Sic Semper Tyrannis!!

Not a problem. My friend and AG Ken the Cooch wouldn’t had put in the complaint there was no severability.

Which leads to me a question for all freepers. Why in the World did Harry Reid NOT put severability in the Senate Bill (which is HR 3590)?

I think the reconciliation is a joke. Obama’s signed his bill - it’s over. If the Senate changes one thing, it’s over.

I guess where I going with this.

The Dems may think they have a win/win on this via the judiciary. If the judiciary goes their way, they have a health care deal that will be difficult to repeal.

If it doesn’t, they can tell their lefty base they tried, use the courts as a whipping boy and motivate their base.

I’m sure some of them are aware this is on real shaky constitutional grounds. They just don’t care.

That makes sense. I believe the main objective in passing this legislation was as an excuse to raise taxes. They have their tax increase for the next four years, and won't have to pay out a dime. And if the Court declares it unconstitutional, the tax increases still remain in place.

It was probably the main selling point by Obama. Congress has finally run out of other people's money, and they needed to find a way to bring in more revenue from now until the election. That's how they got Stupak on board. This was never about health care, but rather it was about raising taxes.
