In order to persuade reluctant Democrats to endorse his favored health-care reform bill, President Obama promised to issue an executive order stipulating that the legislation does not allow for funding of abortion. Readers who are not familiar with the American form of government might wonder how much authority such a presidential order would have. 

Readers who are familiar with the American form of government know that such an executive order would have no binding force whatsoever. 

Under the terms of the US Constitution-- a document with which most legislators are evidently unfamiliar-- Congress has the power to legislate. The President does not. If the legislation passed by Congress allows for funding of abortion, and the President declines to provide that funding, then he is violating the terms of the legislation. Sooner or later someone will challenge the presidential order in court, and the court will rule that the intent of Congress takes preference. 

So what was the intent of Congress in passing this legislation? Here's a hint: In order to convince a few recalcitrant Democrats that the bill didn't provide for abortion funding, President Obama was obliged to promise this executive order. Clearly that promise was not contained in the legislation itself. 

If the legislation itself blocked abortion funding, the presidential promise would have been meaningless and unnecessary. As things stand, the promise was still meaningless-- but apparently necessary, to give venal legislators an excuse for deserting their own promises.

WHAT A WUSS!!! But, I have little confidence in the people of Michigan voting him out, however. I mean, this is the State that reelected Jenny Granholm Governor and now has the highest unemployment in the Nation. The city of Detroit alone has 30% Unemployment and the State is between 15% & 20%.

Most of you probably know this already, but, there is a Medical Doctor running against Stupak. The Doc has to win the GOP Primary first, however.

A novice Republican challenging Rep. Bart Stupak (D., Mich.) has been gaining support and raising money in the wake of the House vote on health-care legislation Sunday.

“It’s been amazing,” said Dan Benishek, a doctor. “The phone hasn’t stopped ringing.”

Benishek, who has never run for office and has an all-volunteer campaign, says he has raised $50,000 since the vote. He’s also gotten about 6,000 emails, 18,000 friends on the Facebook and more than 3,000 followers on Twitter even though his account looks brand new. Some conservative Web sites have taken up his cause, including the Hot Air blog founded by Michelle Malkin.

“The betrayal of Mr. Stupak was dramatic,” Benishek says. “He certainly betrayed the citizens of his district because he’s from a conservative pro-life area. That was pretty much the only issue tying him to his district. Mr. Stupak tends to vote pretty liberal on most things.”

A spokeswoman for Stupak said the congressman had no comment on the matter.

Ten years from now? Perish the thought. I know that Obama is making us into a banana republic. But he ain't Chavez. And we certainly are not Venezuelans or Cubans.

Does Stupak know that obummer considers abortion a way for his daughters to correct a ‘mistake’ or that when obummer was in the Illinois senate he opposed 3 different bills that would have protected babies that had somehow survived late term abortions?

Of course all he did was speak against the bills and when it came time to vote, he cravenly voted “present” - hence his nickname “Pres_ent of the United States”. Couldn’t take a chance of going on record as being FOR killing living babies.

It doesn’t matter if he signs it or not. It’s worthless because an eo does not trump a law. If taxpayer funded abortion is in law an eo isn’t going to negate it.

I think the first thing we must do is have a Republican in both the House and Senate introduce bills that require Congressmen, Senators, families and staff to be required to be enrolled in this public health plan. The fact that the people who passed this abomination are exempt from it says it all.

Stup-head must pay the price for this.

Dude, it's not a matter of *trusting* 0bama -- it's that no EO can negate existing law, an EO has not the force of law! I don't care how many he or any other presidents sign, I don't care if the next Republican signs an EO making abortion illegal, it is IRRELEVANT.

Unless, of course, Stupak really does believe we live in a tyranny, has confirmed that the once Republic of the United States of America truly no longer exists. Then indeed, he has to *trust* 0bama.
