You cannot retire if your court martialed and seperated on a dishonorable discharge, or other than honorable. I do not believe he will face jail time. I do think he will be quietly retired though. They will most likely ask him to hand in his retirement papers, and they will be thrown on top of the stack, instead of most O-5s and O-6s having to wait months for their answer.
