While Supreme Court Justice John Stevens' decision to retire this summer will give President Obama a second chance in as many years to shape the high court, the upcoming confirmation battle during an election year all but guarantees that his ambitious legislative agenda will grind to a halt.
Obama and his Democratic allies are hoping for a swift confirmation process while pushing through the rest of the president's legislative agenda, including an overhaul of Wall Street, immigration reform, climate change legislation, and a comprehensive jobs bill.
But some observers say getting any of that accomplished this year is unlikely because Supreme Court battles slow things down.
"All of the air is sucked out of the town and it's focused on one issue and one issue only," said Roger Pilon, founder and director of the Cato Institute's Center for Constitutional Studies.
"Mainly the hearings that take place before the Senate Judiciary Committee and of course the run up to that is of course the examination in exquisite detail of the nominee," he said. "And so I don't think the Obama administration is going to get a lot done this summer."

That was the Democratic strategy throughout the Bush administration. Of course the GOP is pinned “the party of NO”.
The Republicans need to block whoever Barry nominates until after the November election. Then they will be able to keep blocking Barry's nominees, at least until Barry starts naming some moderate liberals instead of far left wing liberals.
The big fight will be getting the RINOs in the Senate to hold fast against Barry's first pick for Stevens' seat.

I like this strategy. I doubt the GOP will be able to hang tough that long, but maybe. After Obamacare was rammed through, Juan McInsane said something about opposing everything the One proposes for the rest of the year. Of course, McQueeg says lots of things.
But I always hope. Always.
Will the Stupid Party hang tough on judges? Not likely, but maybe if we not only wipe out the rats this fall, but a few RINOs in the primaries (e.g., Lindsey's pal McCain), they will learn to do the right things. If not, we just have to keep getting rid of them.
This is my nightmare:
John McCain loses his primary which unleashes his “inner maverick” and he votes straight down the line with the Democrats the rest of his term.
If he wins his primary, there is no more need for him to act like a conservative, and he goes back to “crossing the aisle” every chance he gets.

I wish I could cheer you up. But McCain has always been unpredictable. He does whatever will bring the most microphones to him.
