Sen. Robert Byrd, the longest serving senator in U.S. history, is in serious condition in a Washington area hospital, according to aides to the West Virginia Democrat.
According to a statement from Byrds staff released Sunday afternoon, the senator was admitted to the hospital late last week suffering from what was believed to be heat exhaustion and severe dehydration as a result of the extreme temperatures. He was expected to remain in the hospital not more than a few days.
The statement added: However, upon further examination by his doctors, other conditions have developed which has resulted in his condition being described as serious.
Byrds office did not say which hospital he was in, although Byrds doctors described his condition as seriously ill.

Under state law, if Byrd dies in office, the governor would have to appoint someone to fill the seat until the next general election, said Bob Bastress, a professor at the West Virginia University College of Law.

Any vacancy occurring in the office of secretary of state, auditor, treasurer, attorney general, commissioner of agriculture, United States senator, judge of the supreme court of appeals or in any office created or made elective to be filled by the voters of the entire state, judge of a circuit court or judge of a family court is filled by the governor of the state by appointment. If the unexpired term of a judge of the supreme court of appeals, a judge of the circuit court or judge of a family court is for less than two years or if the unexpired term of any other office named in this section is for a period of less than two years and six months, the appointment to fill the vacancy is for the unexpired term. If the unexpired term of any office is for a longer period than above specified, the appointment is until a successor to the office has timely filed a certificate of candidacy, has been nominated at the primary election next following such timely filing and has thereafter been elected and qualified to fill the unexpired term. Proclamation of any election to fill an unexpired term is made by the governor of the state and, in the case of an office to be filled by the voters of the entire state, must be published prior to the election as a Class II-0 legal advertisement in compliance with the provisions of article three, chapter fifty-nine of this code and the publication area for the publication is each county of the state. If the election is to fill a vacancy in the office of judge of a circuit court or judge of a family court, the proclamation must be published prior to the election as a Class II-0 legal advertisement in compliance with the provisions of article three, chapter fifty-nine of this code and the publication area for such publication is each county in the judicial or family court circuit.

I used to say it about Jesse Helms. Everyone knew he was not up to the task and that he had a “minder” to keep him from saying anything inappropriate to the press, yet, they kept sending him back to DC.

Byrd is an expert at bring home pork. When you ask people here about different leftist stuff they will agree with you but they will still not vote against him because he has brought home the money for the state. It is my contention that it has mostly been short term projects that do not provide any lasting jobs but you can never tell a native West Virginian that. While they have a heritage of voting GOP in national elections it is almost impossible to elect a senator who is not a Dem!

Two years is a long time. A Dumbacrat can buy a lot of influence in Washington in that amount of time.
COLD...but funny.
What would be interesting to see is what would happen if Byrd became incapacitated for a lengthy period of time, like Tim Johnson was several years ago.
Unlike the 25th Amendment, which gives the Cabinet some flexibility to replace a President should he become physically (or mentally) incapacitated, there is no such provision for US Senators or Representatives.
He needs to take the sheet and hood off while he's in the house.
