Was it necessary to lob a snarky personal insult at a fellow Freeper? I appreciated Deckhand’s synopsis. It helped me to understand the case. Even if I hadn’t found it useful, I’d have refrained from making it personal with a Freeper in good standing. Obama is the problem, not fellow conservatives.

Whomever wrote this "article" for WND clearly doesn't begin to comprehend the purpose of appellate courts in the US. To posit, as this story does, that this appellate court will be a trier of fact, is a statement that flies in the face of American jurisprudence.
Again the title, "Appeals panel considers whether Obama is even American"", is completely inaccurate. The 3rd Circuit is NOT going to review the merits of the case, nor are they going to review the facts of the case. All they are going to review is the trial court's application of the law with respect to the granting of MTD on the grounds of lack of standing. That's it.
