JACKSON: Nevada Progressives Violate Federal Law to Attack Sharron Angle

The Nevada progressive group, ProgressNow Nevada, is violating Federal Law by using their 501(c)(3) charity tax status to raise funds under the guise of “education” for attacking Sharron Angle.

Due to their charity tax status, ProgressNow Nevada is banned from “advocating for or against a candidate” but is clearly participating in political activity by sponsoring TheWrongAngle.com website, interfering in the US Senate race in Nevada and working in other Nevada races to defeat Republican candidates.

O.K., notify the FEC. Then call a Press Conference, go on O'Reilly, Hannity and every talk show you can (good excuse to get free air-time for Sharron) and expose this thing. Come on, LET'S USE THIS TO OUR ADVANTAGE.

The IRS approved their 501(c)3 application on February 1, 2010. The Obama administration approves of the political activities of ProgressNow.

This story is not complete. These days we need to know what race the perpetrators are before we can decide if a a crime has been committed.

Angle needs to write them a letter putting them on notice that she believes they are in violation of their tax status. She needs to send a copy to the FEC and the IRS. Then, if she does beat Reid, and if no action has been taken by the FEC or the IRS, it might be time to have a chat with these agencies about their future funding.

I'm sure the group picture sent with the application received the approval. Not the information contained there in.

News affecting 501(c)(3) Applications Reprieve!

The estimated half a million small non-profits that were on track to lose their tax exempt status this year for failing to file IRS Form 990-N, have received a (temporary?) reprieve. Several days after the May 17 filing deadline passed,

Doug Shulman, Commissioner of the IRS, announced that the IRS would help small organizations retain their tax-exempt status, promising "additional guidance in the near future," and an opportunity to keep their tax-exempt status intact.

So far, the additional guidance has not appeared, but, long story short, it is not too late to preserve your organization's exempt status by filing your annual Form 990-N.

They are exempt under a greater law. They are exempt under code section 501(c)(democrats).

They have updated the story:

“UPDATE: We have just gotten off the phone with Erin Neff, executive director of ProgressNow Nevada. Ms. Neff claims that under the rules that govern the 501(c)(4) branch of ProgressNow Nevada, a nonprofit 501(c)(3), “the main website focuses on working with groups and town halls” and that WrongAngle.com is a smaller portion of the organization in keeping with the outlines of the Internal Revenue Code, which states, “a section 501(c)(4) social welfare organization may engage in some political activities, so long as that is not its primary activity.” When asked of the physical separation between ProgressNow Nevada and its 501(c)(4) entity, ProgressNow Nevada Action, Ms. Neff said that the two operate “in one office.” When asked why WrongAngle.com claims that “The Wrong Angle is a project of ProgressNow Nevada” as opposed to ProgressNow Nevada Action, Ms. Neff said that she had given the web designer “a long leash” and was not aware of the attribution to the 501(c)(3).” Sounds like BS to me — blaming the web designer is the oldest trick in the book.

“It’s not immediately clear how much money ProgressNow has raised while WongAngle.com was identified as a 501(c)(3) nor if WrongAngle.com donors are aware they have been incorrectly informed.

Update: ProgressNow Nevada has changed their website to say “Make a donation today: help us advocate for progressive solutions.” — seemingly admitting that they have been soliciting donations for a 501(c)(3) via political means.”

There isn’t a single path of deceit that Dirty Harry will not trod.
