FBI Examines Civil Rights Case (Death of Shirley Sherrod's Father)

FBI agents have requested and received documents connected to the man who some believe shot and killed Shirley Sherrod's father in rural Baker County in 1965, court officials said Friday.

While Sherrod has been the focus of media attention following her dismissal from the U.S. Department of Agriculture and the subsequent apology from President Barack Obama, the death of her father when she was 17 has been has been discussed but not prominently.

But the shot fired the night of March 15, 1965, has begun to reverberate again in Baker County after an FBI agent requested documents Friday connected to the only man charged in Hosie Miller's death, Cal Hall.

According to Baker County Probate Court officials, the agent requested the death certificate of Hall, who was also known as C.A. Hall, Jr. Hall died in 1976.

According to the documents obtained Friday, Grace Miller and her brother-in-law, Walter Miller, tried at least three times to get Hall tried.

On the night of the shooting, Grace Miller swore out a warrant against Hall for assault with intent of murder. Despite the fact that Hosie Miller had since died, that charge went before a grand jury on Oct. 27, 1965 and was dismissed.

Finally, on Jan. 17, 1966, Walter Miller again tried to bring murder charges against Hall but was unsuccessful.

Eight days later, on Jan. 25, 1966, Grace Miller, with the assistance of famed civil rights attorney C.B. King, filed a wrongful death lawsuit against Hall alleging that Hall shot Miller in the chest while in Miller's cow pasture off Route 2 in Newton on March 15, 1965. According to court documents Miller was seeking $330,00 to recover present and future lost wages, medical and funeral costs.

In his answer to Grace Miller's original complaint, Hall's attorney stated "the Defendant says that he is not indebted to the Plaintiff for any sum or amount for the reason that the killing by him of Plaintiff's husband was in self-defense."

Despite King's efforts to have the Baker County Board of Jury Commissioners redraw the jury lists after he said that the jury panel was comprised of a disproportionate number of white jurors given the fact during the 1960's census the majority of Baker County's 2,000-plus residents were black, Judge Emeritus Carl E. Crow went forward with the proceeding and on Sept.12, 1966, the jury found in favor of Hall.

The only point is to stir up the race issue.

These people should watch what they 'stir up'. Having grown up in the Deep South in the 1960's, I am confident that the DA, the Judge, the Prosecuting Attorney, and half the jury are all DEMON RATS. If they want to bring up the past, we need to make sure it all gets brought up, including the fact that it was the Democrats, and only the Democrats who practiced Jim Crow, discrimination against blacks and denied them justice.

Miller tells two versions. Grace Miller's wrongful death suit alleged that her husband, Hosie, was shot in the chest.

I agree with you, if he was shot in the back, Hall's claim of self-defense is weak, and maybe collapses entirely.

OJ lost his civil suit. Partial justice. In the Hosie Miller case, the jury hearing the wrongful death suit found the shooting to be justified. There was a trial, and Hall would have been liable if the evidence was more likely than not that he was not acting in self defense.

I bet the pleading and answer are at least available, public record of the trial.

I can understand bitterness on the part of the Miller family, and Ms. Sherrod too. But if the history is really this murky (IOW, if the suit and facts are equivocal, and Hosie was shot in the chest), then prudence dictates keeping the bitterness to yourself. Puffing the story up is risky.

For all we know, and I'd like to think this is true, Hosie was well liked by the community, and Hall was viewed as a hot head, so that in the event of a trial, the bias ran in favor of Hosie. IOW, perhaps this was an upstanding color-blind community and jury.

Since they are making this a racial event, I assume that Hall was Caucasian, if so, that would have made that a jury of his peers.

Peers is not meant to have anything to do with race. It's meant to draw a jury pool from the governed rather than the ruling class.

That's the only way to bring up the past. ALL of it must be reexamined for a truthful outcome.

Anything else is simply propaganda.

You can bet Holder/Obama told the FBI to clear the case to accuse the dead man of the homicide. If the FBI has nothing better to do they ought to go to AZ. and enforce the laws re. entering the country illegally

I guess it is safe to say based on Sherrods husbands completely contexted comments that he is in fact a Racist and hates White People with extreme prejudice, much like Jeramiah Wright whose sermons were completely contexted and his racist hate was shown to have infected the Obama’s as they sat in that hate filled church for all those years....

No mention if he was a black relative or a white relative. Either way, family on family violence is a common occurrence. Makes you kind of wonder why after 45 years, and especially at this point in time, this is being delved into.

Perhaps not. The article said Mrs. Miller was distantly related to Hall, so it's anybody's guess.

This is a favorite trick of the leftwing media, lawyers & politicians. Blacks being a majority of residents does not mean they are a majority of the pool of eligible jurors. The pool of residents includes children (which some groups have more of) convicted felons & others barred from serving on a jury.

The left is allowed to get away with this switch all the time. Just recently, in a settlement of an election "discrimination" suit, they used the fact that Hispanics were under represented based on their percentage of residents. But again residents include children, felons and also illegal aliens (which the area in question is known for) - who are not allowed participate in elections.

In the deep south in the 1960’s any kind of real justice for blacks was quite rare. And the fact that the alleged killer, Mr. Hall, and every single white juror and Grand Juror in the criminal and civil cases were undoubtedly Yellow Dog Democrats never seems to be mentioned by anyone. Funny, that.

My take is....the Obama crew want to show the country the racism of the local and state governments of the Deep South - which are red. Prove to the country that the Feds need to come in just as they did during Reconstruction.

Can we say, control the vote?

“Sherrod’s father, Hosie Miller, had a dispute with a man over cows that had come into his pasture. The neighbor insisted that three of Miller’s cows were his. Miller said he would call the “law” to settle the dispute. As Hosie Miller was closing the gate, he was shot in the back, the family says.”

Back in the day they shot cattle thieves...
