Except that the DMCA ruling required the website to first post a notice with an address for their agent of service for such requests. Any website that didn’t do so loses their protection under DMCA.

Jim put up his notice two weeks ago. Word on the street is most websites, including FR, are not going to fight and are negotiating a settlement since the violations are clear and they didn’t avail themselves of the protections brought by the DMCA ruling.

Bob, we have received nearly 300 DMCA take down notices during the last 10 years or so and we’ve fully complied with each and every one of them. The reason for the registration is so that a publisher can find the name and address where he should send the notice. Obviously, not one of these 300 or so publishers had a problem finding our address since it’s been posted on every page of FR since 1998 and my email address is posted on the home page as well. Also, we are registered with gkg.net and Righthaven is very much aware of that since they use that source to unethically spring frivolous lawsuits on people with no prior notice and threaten to have their registered domain names transferred to them. Sorry, pal, but you and Gibson will learn that we are very much covered by DMCA and we fully comply with the law in all respects. The congress set up DMCA to make the resolution of these nickel dime hassles routine and not matters to clog up the federal courts. We demonstrably comply with the intent of the law as enacted by congress, Righthaven does not. Call your good buddy Steve Gibson back and let him know that you and he are both losers. And while you’re at it, get a life. Can’t believe you have the gall to post on FR after you’ve joined Gibson/Righthaven against us. You really are an ass.
