Voters in 3 states to consider opting out of 'Obamacare'

DENVER | After taking a beating at the hands of Missouri voters in August, "Obamacare" could be roughed up once again at the ballot box in November.

Following the lead of the successful Missouri initiative, which passed with 71 percent of the vote, Arizonans, Coloradans and Oklahomans will decide this fall whether to approve proposed constitutional amendments that would allow them to opt out of key provisions of President Obama's signature national health care law.

The three initiatives prohibit the government from forcing individuals to buy health care insurance - a "mandate" that critics say violates the U.S. Constitution - and would allow patients and employers to pay providers directly without penalty. The idea is to protect state residents from "the ongoing takeover of health care by government," backers of the Colorado campaign say.

There's just one problem, say opponents of the state ballot initiatives: The entire strategy is "an exercise in futility," in the words of Oklahoma Gov. Brad Henry, a Democrat. Federal law trumps state law, meaning that the measures are certain to be overturned even if they win 100 percent of the vote.

"No state has the authority to selectively ignore federal laws of its choosing, no matter how much some people may dislike them, and any attempt to do so will be ruled unconstitutional by the courts," said Mr. Henry, who opposes State Question 756. The only practical outcome of the vote, he added, would be a "costly legal battle."

GALVESTON, Texas _ For all the uncertainty swirling around President Bush's proposal to offer private Social Security retirement accounts, there is a corner of the country where the idea has already been tried and tested for a generation.

Three Texas counties hugging the Gulf of Mexico voluntarily withdrew from the federal Social Security system in 1981, transferring the retirement taxes of county employees into private investment accounts.

That's the good news: As the nation prepares to debate a momentous potential change in the bedrock federal retirement plan, there are some real-world experiences in Texas available to be studied as test cases.

The bad news is that the verdict is decidedly inconclusive. No one here can agree whether county retirees are better off than they would have been had they stayed with the Social Security system _ a dilemma that precisely mirrors the emerging complexities of the national Social Security debate.

Someone is funding a huge campaign here in Arizona and although the signs list pretty much all the ballot initiatives as against the Constitution, my guess is the health care one is their main target. The signs even look homemade-ish, but there are too many of them for it to be grassroots, so to speak.

The FL Constitution unfortunately allows the Tallahassee Taliban, aka Supreme Court to remove Constitutional amendments from the ballot. While Constitutional, it is wrong and violates our Natural Right to determine our form of government.

Governor Henry, like most Democrat office-holders is apparently semi-literate and found reading all the way to the 10th Amendment beyond his limited abilities. I think he stopped at the 5th.

I wonder if there is any realistic chance for a state with a significant black or Hispanic population to ever opt out of Obamacare? I live in a state with a relatively high black population, and the majority of them live off of the government. The only difference in their situation over the last 200 years or so is that the majority of blacks have changed masters. Uncle Sam is the new slave messa. I take no delight in seeing how little has actually changed for the majority of blacks in my state. I would say that things have actually gotten worse for them since the 1960’s. Just like everything else the government has done, Obamacare will end up hurting blacks more than any other ethnic group in this country.

Brad Henry is term-limited and cannot run for re-election (thank God we passed that Constitutional amendment a few years ago, by a vote of the people, no less.)

Come November there will no statewide office held by a Democrat, all the Congressmen and both Senators will be Republican, the state house and Senate will be held by Republicans. Let me guess what the outcome of State Question 756 will be.
