Last week, we blogged about the Southern California family that claimed foreclosure fraud and broke back into the foreclosed home they were evicted from, just days before the new owners planned to move in. The family acted on the advice of their attorney, Mike Pines, after he reviewed their situation and encouraged them to take back the home they were allegedly wrongly evicted from. Some readers commented on the appropriateness of the this lawyer's actions.

Any lawyer who tells his clients that it is OK to commit burglary because the foreclosure paperwork may not have been properly filled out should be in jail, preferably right next to their client. If the lawyer felt they had a good case, he should have advised them to sue the bank, not to break into someone else's house.
Fabulist and other readers who share the same sentiment will be happy to know that Mr. Pines has been jailed. Unlike the previous break-in, where the police allowed the family to pick the locks and move back in, the police in Orange County did not stand by and watch. Instead, the law enforcement there arrested him and his client for vandalism and trespassing after they smashed a window in their attempt to reclaim the home in Newport Beach. The Orange County Register broke the news of the event:
A Newport Beach man was arrested Wednesday after an attempt to regain possession of the home he claims his family was wrongfully evicted from 16 months ago.
Rene Zepeda, 72, was accompanied by his attorney and several Newport Beach Police officers as he made his way to the back yard of the spacious home at 19 Crystal Cay and, wielding a hammer, broke a window...

The guy ought to be lucky that he didn’t try this in eastern Tennessee or another free state - 00 buckshot generally will stop an intruder.
My Dad used to warn me to careful not to take a situation where I am entirely right and the other side entirely wrong, and foolishly turn it into a situation with right and wrong on both sides! It only confuses the issue and makes it that much more difficult for you to prevail in the end.
I have seen this wisdom play out so many times in my life! For most of us when we’ve been wronged our first response is to seek revenge, to get even. And although it feels good, sometimes very good, at the moment, it can surely make things much more difficult down the road.
