If the morons can’t spell Murkowski’s name correctly or are unable to fill in the little oval, they probably shouldn’t be voting anyway. Toss that crap.

WOW!!! Awesome. I read the Lawsuit. The Supreme Court ruling in Bush vs. Gore, 2,000, backs up Joe Miller’s case. If the Federal Judge rules against Joe Miller’s Lawsuit, hello Supreme Court.

Joe Miller's lawsuit, addresses that: The "prior case law" they are citing, did NOT apply to a "write-in" ballot; it was in reference to "marking" a ballot.

Huh? Bush v. Gore was decided by applying the Equal Protection Clause to the value of an individual’s vote.

Had Gore asked for multiple recounts in the entire state, and not just the three counties where he would have picked up the most votes, the USSC would not have decided the case as they ultimately did. The argument was that some votes in Florida were being treated differently than others by being counted more times, and that decision was 100% correct, IMO.

Click on the link at the top of the article and read the lawsuit. It specifically addresses Bush v. Gore. The SCOTUS more or less said, there have to be specific guidelines adhered to; you can’t just use discretion.

Read the lawsuit.

I’m not sure the Bush v. Gore applies, though. As long as all of the votes are handled the same, any deviation from guidelines would likely mean another appearance in front of the USSC.

That witch tried some stuff during the primary too and Miller handled it beautifully. He had his own lawyer (team?) and oversaw the counting. He epitomized how our side should handle oversight of these elections and it’s NOT by letting ‘things fall where they may’.

I remember seeing the list of those who applied to be write in candidates. There was another Murkowski on that list. True that it said that person was denied for not getting the paperwork in before the cutoff(And I wondered if that was really true). Yet who can say that someone who knew that other Murkowski did not vote for them. This SOS would never have allowed another Murkowski on the list because then the first name would have to be right as well, and all ballots with only a last name would have to be rejected. I do not know how to find that list again.

Very interesting brief - not only did they cite Bush v. Gore [Equal Protection Violation], but also invoked the provisions of the APA about revisions in regulations ...

And will again. I think the rule of law here in Alaska will be completely ignored. The state is basically functioning as proxy Murkowski staff. Judges will ignore any case law favorable to Miller, and voting staff say "Napoleon Bonaparte" scribbled on the ballot in crayon is close enough to count as a Murkowski vote.
