I am unaware of a crime of “refusal to submit to federal authority”. A google search of that phrase turns up only this thread.

They can arrest for probable cause, and a refusal of a search can trigger probable cause in some cases (like a refusal to submit to a breathalyzer, for instance). But, it seems to me they’d need something besides simple refusal to trigger probable cause, and thus allow an arrest.

Although I am not a lawyer, that was along the lines of my thinking. This probably needs to be nipped in the bud but I am not sure how it would be done.
