HILLYER: Scooter Libby, on the record

Memory can be unreliable, and misstatements can happen despite pure intentions. It's only fair game to point this out.

So say Valerie Plame Wilson, former CIA case manager and Vanity Fair cover girl, and her husband, Joseph C. Wilson IV, former ambassador to Gabon and extravagant self-promoter.

Too bad the Wilsons, a power-mad federal prosecutor, an officious federal judge, a confused jury and a badly misled president wouldn't apply those same common-sense considerations to I.

Lewis "Scooter" Libby, wrongly convicted of perjury in the case stemming from State Department official Richard Armitage's public identification of Mrs. Wilson as a CIA employee.

For the very first time since his conviction, Mr. Libby - former chief of staff to then-Vice President Dick Cheney - went on the record about his case.

As both Wilsons tried to explain away, each of them has been caught making significant false claims. Each claimed memory played tricks on them. The ambassador even justified one of his key falsehoods as "a little literary flair."

Yet neither Wilson was convicted of a felony.

Mr. Libby was. He paid a quarter-million-dollar fine, served 400 hours of community service and had his law license taken away. All of this over a single dispute about whether his memory or that of TV journalist Tim Russert was correct, about a months-past conversation that had nothing to do with the actual leak of Mrs. Wilson's name.

Never mind that Mr. Russert's own memory had proved flagrantly untrustworthy in a previous instance.

STARWISE points out that Bush refused to commute the death sentence of an admittedly guilty woman who found God prior to her execution. She found God just in time to be welcomed into his loving arms, but her finding of God didn’t make her less guilty or less deserving of her sentence.

Libby’s case is entirely different. There is no evidence of Libby being guilty, and quite a bit pointing to his innocence. Besides, even if he did lie, his lie was immaterial and thus does not constitute perjury.

On sound principle Bush refused to commute the sentence of the murderer. For political expediency Bush refused to pardon Libby.

The bottom line that Bush is just another elitist. Unlike Barry Soetoro he’s qualified to hold the presidency, and he’s a far better man than Barry Soetoro, but if America is to return to Constitutional government, the day of the elitist is over, otherwise sit back and enjoy the rule of the oligarchs.

how ‘bout Obama pardons Ahmed Khalfan Ghailani, convicted of just one count out of 285 .. for the US embassy bombings in East Africa .. because in his mind he thinks there must be something amiss

Obviously, unlike Obama, you believe there was nothing amiss in this trial.

Again, there was plenty of law, it was all over the place. That's all we need, law.

How about Obama, in his mind, he thinks there must be something amiss, so he orders Ahmed shot behind the courthouse?

It’s clear I was giving you an example illustrating a similar situation of a final jury verdict.

Sorry, but George Bush didn’t give a damn for the “party.” He used it to get elected, but once that was accomplished its leaders were discarded like used Kleenex. He certainly doesn’t give a damn about it now.
