SWAT entry questioned in Marine's death

A Pima County Sheriff's Department SWAT team shot and killed Jose Guerena eight days ago; it was executing a search warrant.

Four days ago, in a news conference, a sheriff's deputy said the department makes it clear when SWAT is about to enter a home. Lt. Michael O'Connor says SWAT says it never wants to be mistaken for other people, "We had our large armored vehicle there with the markings on it. It also has lights and sirens. It was going. So we do everything we can to try to portray the image that we're law enforcement, we're not home invaders."

But, Guerena's wife, Vanessa, who hid in the closet with her youngest son while 71 rounds were fired her husband's direction, said she heard nothing. At any point did you hear them yell, ‘police" or ‘SWAT'?" KGUN9 asked. "No, no!" answered Guerena.

A neighbor who heard the shooting corroborates the wife's account, "The only sirens I heard out here were like maybe 20-30 minutes into the entire ordeal," said David Watson.

Watson is very familiar with gunfire and stressful situations; he's a Vietnam combat veteran, "I want to make this as clear as possible: you only heard the announcements after you heard the gunfire?" asked KGUN9 reporter Joel Waldman. Watson quickly answered, "Yes!"

SWAT also entered another neigbhor's home they shot up during the killing WITHOUT a warrant. So much for those anti-penetrating ammo rounds, right?

Today, KGUN9 also learned SWAT Guerena's neighbor's house. "When I came home, the whole house was searched. All the doors were open. And, (our house) was searched through; it was like an invasion of privacy," said Carissa Franco.

SWAT says it was concerned about a hole in the Franco's home, worried someone else could've been wounded. So, it said it did what they needed to get inside.

Pima County released a statement about that breach, saying in part, "The Regional SWAT Team made entry into two additional residences very soon after the deadly force encounter. This was done in order to ensure that there were no injured persons in those residences as a result of the shooting. These entries were made without warrants due to the exigency of the circumstances. No one was home at either residence when entry was made.

Wife had to find out from 911 call to get her dying husband an ambulance that it was police outside her door.

Waldman: “At any point, did you hear them yell ‘police’ or ‘SWAT?’”

Guerena: “No.”

Waldman: “At any point, did you hear sirens outside?”

Guerena: “No.”

Waldman: “As far as you know, did Jose have anything to do with drugs?”

Guerena: “Oh, no, you can check, they can check, everything... They didn’t get anything at the house. They stole stuff, like my ring, his wallet, stuff like you can’t even imagine, personal stuff.”

Waldman: “What do you want to know?”

Guerena: “Why? Why? Why did they do this to him? Justice. I want justice. I was justice for my kid.”

What’s this bullshit about sirens BEFORE a dyanmic entry? Jeez, just watch an episode of cops and you’ll see that is never the case.

They show up with a tank, body armor, armed to the teeth,beat down the door with an entry tool, and shoot anyone inside that objects, but they aren’t home invaders.

That’s almost funny if it weren’t so pathetic.

A) The Pima County Sheriff’s Department has decided to grant no more interviews on this issue for the time being.

B)SWAT raid fatal drama is revealed in 911 call - AUDIO

The operator tells Guerena to grab a cloth and apply pressure to his wounds, but the wife responds frantically: “I can’t! I can’t! There’s a bunch of people outside of my house. I don’t know what the heck is happening!”

C) Details of the search warrant have not been made public and deputies would not comment on what was seized from the home.

D) Three other homes within a quarter mile of the Guerena house were served search warrants that morning as part of the sheriff’s investigation. The addresses and the names of people who live in the homes have not been made public.

Why in the world wouldn’t they simply pull this guy over when he drove away from the house or grab him as he went outside at some point?

From a safety standpoint (for all involved), it seems senseless to bust down the door and rush into the unknown.

I don’t know much about this situation, but it sure doesn’t sound like there was imminent danger (or a standoff) being addressed here.

I consider myself a reasonably prudent individual and if it were the middle of the night, with sirens blazing, red lights flashing and someone was beating on my front door I would be very defensive, especially if that person suddenly busted through the door aiming a weapon at me.

The SWAT team knows what’s going down, the innocent person in the house has probably been awakened from sleep, is possibly scantily clad, and not trained to think well in all the confusion, confusion intended to disorient them. And that would go double for a Marine who had been in combat!

It’s also a problem that EVERYONE is yelling, and in the chaos it’s not impossible that they are yelling conflicting orders. Damned if you, shot if you don’t is not a good policy.

With the explosion in SWAT teams around the country as a result of Homeland Security spending it’s become VERY important that we come up with an objective, workable, open and above board policy for dealing with these incidents.

In less than 10 years we’ve gone from a few hundred SWAT teams to over several thousand. And some agencies are still depending on the procedures and protocols that were established before they had the SWAT capability.

I don’t know the answer, but someone smarter than me needs to come up with something to address the problem.

They did it because they, in my opinion, have Hispanic names. Their reasoning probably went along these lines,"Look at them damned Mexicans living in this nice house. They are not supposed to live in a house like this. The only way they can afford a house such as this is be involved in selling drugs and prostitution. The guy is dealing drugs and the woman is hooking. We will knock them off and take their money and drugs.

And as evidenced by past history, in time, the drugs will mysterily disappear from the evidence room and the cash will be used in the purpose of new toys for SWAT.

The fly in the ointment was that they found no drugs. The guy worked at one of the mines for a living.

From this point in time on, I would not doubt anything they said they found in the house. They found it because they put it there.

I wikll not doubt anything they say that they say that he was involved in. They murdered him, now they must frame him. And last but not least, I will not be surprised when they trump up a charge on the widow and arrest her. She must be thourghly discredited.And his orphan son? They will place him in foster care.

This entire case does two things:1. It makes decent people sick to their stomaches. 2.It gives the bootlickers orgasims.

Yeah. What is the purpose of the "dynamic entry" if you are going to announce your arrival with sirens five minutes before you get there?

The longer it goes the more unbeliveable the coverup lies become.

You don't believe that one? Try this one.

The fact is that they murdered an innocent man. Also his widow, orphan son, and neighbors were extremely fortunate that they also ere not killed. Look for the widow to ae arrested on some trumped up charge and his orphan son to be placed in foster care.

But, but.. when I see these raids on TV cop shows, they usually park around the block and sneak up on the house.

This sounds like Detroit ~ Pima County seems to have an armored vehicle. They can make a dynamic entry that'll pull your teeth.

I'd gather it's the "shock and awe" factor.

Remember, this county is run by the same Democrat sheriff who allowed that nutcase loose to assassinate a Republican judge.

Its just like so many other incidents, its all backwards, could,nt they just have knocked on the door, showed their I.D and the search warrant?

I can not believe people on the police force can be that stupid and or cowardly, meaning it was just murder.

What do our elected servants think about all of this? or do they even have anything to do with it? if this police state business is beyond their control we need to here it from their own lips, we need to know if we our voting for some one with a police state mentality.

Do the people of Pima county want a swat team that can go to any ones house and just start killing? as that seems to be the purpose of swat teams.

Are there any one in Pima county who cheered this police action? Remember what Jesus said? do unto others as you would have them do unto you.

Seems to me this is police terrorism, and if that is what the majority of the American people want then they need to understand that the constitution forbids mob rule, the rights of the individual and or the minority is protected by the constitution.

We need to abolish terrorism by abolishing the terrorist organizations, the A.T.F. the I.R.S. and all swat teams and a whole bunch of other government organizations that are for the purpose of terror to the citizens of the United States, if we don,t then it is beginning to look like America is definitely the end time beast spoken of in the bible.

On another thread about this topic, a witness was supposed to have stated that sirens and lights were not used. I'm sure the vehicles were equipped with them though...just a misunderstanding...

That seems to be the case as with most other swat team incidents, murder for hire.
