I'll bet you're right. Mrs. Guerena's lawyer has already stated that not one of those "suspicious" items is illegal to own. The ball is in Dupnik's court; put up or shut up. Still no word (that I have heard) whether they found anything at all at the other houses or if they even went through with raids on them.

There was a warrant. Safe to assume for his arrest. They could have stopped him in traffic without incident for a tail-light or whatever BS reason. It ain’t sexy, but everyone would probably survive it

I never said that was the preferable course of action.
Why not tell him the truth? (Thus keeping the 4th & 6th unviolated.)

Then why is in sealed? Under “double secret lockdown probation”?
Why have the claims of what the SWAT was mobilized for changed?
(First it was “drugs,” then [IIRC something like] “conspiracy to distribute drugs,” now there’s something about groups performing home-invasions. Why the changes? The warrant would be definitive proof as to WHAT they were doing/looking for; if it even exists.)

Plus, it was originally claimed that the warrant was for multiple homes; if that is the case then is it possible that he was not named? Or that his house was mistakenly referred to by the warrant?
Or else the warrant could be for a different house entirely.

That is true, and it doesn’t even have to be that, you could give a detective a tangential-ish case (such as something involving someone he knows or works in close proximity to) and have him pull aside the guy for questioning regarding it... In fact, you could probably have gotten him to come down to the station of his own accord saying something like that.
But, *gasp* that violates OpSec!

Given the history of this Sheriff department, it’s completely plausible there wasn’t a shred of truth involved in obtaining a warrant, IF there is in fact a warrant at all. But let’s assume there is one and there was cause for obtaining one.

There’s multiple scenarios where this suspect could have been taken into custody that would not have endangered anyone and any evidence remained untouched. All we needed is a whole lot more Sheriff Andy Taylor, and a lot less, inept Rambo wannabe.

No! I claim that they have separate, independent powers of investigation and DO NOT _NEED_ information from existing investigations to do so.
Further, I claim that the Grand Jury has the power to ORDER a Prosecutor to take up the prosecution of a case; this is known as a PRESENTMENT.

These two powers can be LEGITIMATELY combined to root out government corruption and cover-ups such as are quite likely in this case.

Independent? It all sounds nice on paper, as the information and alleged evidence provided to grand juries are certainly NOT independent. Many times, they only have what they are provided by the cops.

The cruel fact is, most everything Grand Juries have to work with and review, come *DIRECTLY* from those who conducted the initial investigation.

And if this goes to a grand jury, guess where they'll get most all their supporting documents and alleged evidence? That's right, they'll get it directly from the Pima County Sheriff's Department, and the Pima County SWAT team.

However, they won't be getting *any* information or statement from dead guy, other than an autopsy report.

This is why grand juries are *not* a perfect remedy for law enforcement corruption.

In most cases, the cards are stacked in favor of the government, and those in government who perform the initial investigations.

It's just the way it is.
