I honestly don’t know the facts regarding movement on this issue. I DO know that there is precedent....since other presidents have taken similar actions in the past.

When RATS took the senate while GW was president, they kept 2 senators in town, daily,to open and close a session. The Congress, therefore, was not technically in recess and the president couldn't make a recess appointment.

I'm not sure if the same can be done with the House

I'm sure the xperts at FR will chime in.

Well, he can only take the action for 60 days - then he has to get congressional approval. The 60 days have passed and the regime has said they have no intention of stopping the Libya action and they don’t intend to seek congressional authority!
