SAN ANTONIO Public prayer will be allowed at a Texas high school graduation after a federal appeals court on Friday reversed a ban won by an agnostic family that claimed ceremony traditions such as invocations were unconstitutional.
The 5th U.S. Circuit Court of Appeals granted an emergency appeal filed by the Medina Valley Independent School District. Its San Antonio-area high school was ordered by a federal judge earlier this week to forbid students from asking audience members to join in prayer or bow their heads during Saturday's graduation.
The lawsuit was filed on behalf of Christa and Danny Schultz, who said watching their son receive a diploma this weekend would amount to forced religious participation. The Castroville parents argued that traditions such as invocation and benediction excluded their beliefs.
Texas Gov. Rick Perry and various conservative groups, which had rallied to the defense of the school, hailed Friday's ruling by the three-judge panel.
"It should not be illegal for students to say a prayer at a graduation ceremony. Now, the federal court of appeals agrees," said Texas Attorney General Greg Abbott, who filed a brief in support of the school.
The Schultzes lawsuit was backed by the Washington-based Americans United for Separation of Church and State. Ayesha Khan, an attorney for the organization, said the group was "deeply" disappointed but would continue with the lawsuit to try to rid the school of promoting religion in its ceremonies.
"Students should be able to attend their graduation ceremonies without being pressured to participate in worship," Khan said. "All children should feel welcome at this important event in their lives regardless of their opinions about religion."

Students should be able to attend their graduation ceromonies with the freedom of religion to speak about their faith.
Even if this ruling is over-ruled, even if by the Supreme court, people should begin to openly defy the order. The speaker should launch into a prayer. The crowd should too.
And this needs to happen every place they say we can’t. They cannot arrest all of us. The day Christians decide to quit obeying this unjust oppression is when we win. The truth is that they count on us to obey rulings. But there are a LOT of us.
The judge was seeking to nullify the Constitutionally defined unalienable rights of the people. For this he should be removed, sooner rather than later, because he not only does not comprehend OUR Constitution, he is in violation of the law that Constitution established and he presumably swore an oath to!
True. Also, the judge is elected. He may have just written his pink slip.
They live in quiet fear that one day,,, we will simply laugh and begin to do what we want. They won’t resort to force,, there are too many of us, and we are too well armed, and we are simply wanting to be left alone. We are harming nobody.
Everywhere people finally get enough, they win. The Berlin Wall, Moscow, Orange revolution in Ukraine, the Philippines,,,, One day, maybe we will dare them too. TEA is a very small warning to them.
I had an even better idea, mystery prayer.
Just imagine, halfway through the ceremony, unannounced, someone emerges through the crowd with a paper bag over his head. Offers a prayer and perhaps even a short sermon, and then disappears back into the grandstand.

The reversal of the 1st Amendment, from protecting freedom of religion from government oversight, into granting or restricting religious expression through government process, is the clearest possible example that a different kind of law is being imposed.
Instead of screaming about what the judges decide to grant or not, people should be examining the process by which the judges claim to be able to decide anything about the issue at all. If that was done, the Great Secret would be exposed.
But as few ever look at this underlying claim of administrative power... The Band Plays On.

There should be flash mobs at all graduations. If many can break out in song in malls or food courts, why not break out in prayer at graduation ceremonies?

Maybe people can agree on some prayer that would be said in such “protest” circumstances. Something short and non-sectarian.
Maybe it could even be the “serenity prayer”
God grant me the serenity to accept the things I cannot change, the courage to change the things I can, and the wisdom to know the difference.
Or something like that. About that length, easy to memorize, and suitable for the occasion.

The idiot federal judge that made that reprehensible ruling really...really...needs to be removed from his post. There needs to be some legal mechanism where the people can boot such a fool. I wished the Texas governor would have had the fool arrested and escorted off Texas territory.
