Also didn’t this happen in the middle of the night? Who in their right mind who was not doing illegal things open their door to anyone who yelled “open up”? Good Lord don’t they think that people who want to home invade do this too?

“The photos show the interior of Guerena’s home - its walls painted a dark gray - and evidence collected at his home and three others searched that day. The photos show guns, ammunition, vehicles, cash, documents, cellphones and other items found at the homes or in the vehicles.”

Ah. To justify killing an innocent, show stuff belonging to the guilty. Legal stuff to boot.

Rope.

"I believe my life was in danger and the other operators that were also there, that their lives were in danger as well," he said.

'Operators' is military SpecOp talk. It has no business being used by civilian LEOs, period. It clearly demonstrates the militarized mentality under which they are working.

The officer said he then fired nine or 10 rounds from his handgun while holding it with one hand before the gun malfunctioned. He and other officers told authorities they saw splinters coming off the doorway during the shooting.

He fell while attempting to reload, he said, prompting the other officers to believe he was hit.

What a bunch of friggin Keystone cops.

1) it was IMPOSSIBLE for SWAT to have seen whether he had a rifle or not, let alone if it was pointed at them.
a previous thread by an ex SWAT officer said that, based on the sunlight outside.
(compared to the darkness of the interior.)

2) the statement of the wife, makes it clear that the Marine didn’t OWN a rifle, and she saw them drop the “big gun” next to the body.

Evidence photos of the 'body armor' which was USMC issued gear.

Police Changing Story About Murdered Marine "Pointing Rifle" At them Now

He said, "…as soon as I saw the male suspect come from that direction he yelled something. At that point I began firing my weapon at the suspect."

On closer questioning, that officer told detectives, "…whether at that point he actually had raised the rifle up...I couldn't..."

The SWAT member holding the shield at the door said he saw a muzzle flash. The detective asks: "Where was the muzzle flash?"

The shield holder replies: "Directed right towards us."
Another Lie as there was no shooting by the Marine.

And the team commander says, "Immediately I saw a muzzle flash and gunfire or heard gunfire." he went on to say that Guerena "Raised the rifle and pointed it towards us and fired multiple times."

Do these cops lie like this in every case?

Wonder what made those nonexistent muzzle flashes.

A strong ex post facto need to create an excuse for the cold blooded murder of an innocent man?

At this point anything a badge says is immediately suspect until proven otherwise.

It seems like everyone is lying to us now — I don’t even need the tin foil hat. From just about every politician to most of the media to the teachers’ unions to the cop unions....

And not the usual lies and claims politicians have been making forever, but things like “she opened her eyes for the first time.”

I’m so sick of the moral-less, value-less, rudderless ones in control.

In all seriousness, the SWAT officers should be removed from their duty.

If you can’t tell the difference between the sound of gun fire and muzzle flashes directed toward you when there was none, you really are hazard to yourself and co-workers.

All the SWAT officers stated that the dead Marine pointed his AR-15 at them and fired multiple times.

This simply did not happen.

Why are the PIMA SWAT officers lying? Or, are they so poorly trained in firearms they can’t tell the difference between a firearm that is on safety and one that is actively firing?

Both scenarios are scary for the public.

Fear they may be held accountable for manslaughter or murder?

“The people on this thread have their own agenda.”

“Jose Guerena was born in Mexico and I understand that his wife was an illegal alien. Does anyone know if Jose Guerena was an illegal alien? His whole family is under investigation.”
/// others have already covered this with facts that have been known and READILY available for a long time.
So what is YOUR agenda for making this easily disproved lie?!?
- - -
“ The SWAT team had every reason to expect great danger going into that house.”
/// FALSE !!! ...the SWAT team had ZERO reason.
in fact, they didn’t even have enough to ARREST the Marine for!!!
and, their own SWAT VIDEO proves this, with them LISTENING TO MUSIC on the radio, and standing around clearly relaxed.
- - -
“The cop-haters on FR just don’t want to deal with the problems of the Mexican drug gang invasion in southern Arizona.”
/// i’ve seen ZERO cop haters here. except for bad cops.
and there ARE Trolls on FR. but that doesn’t invalidate every topic criticizing Obama, etc.
- - -
“Americans are subject to unconstitutional no-knocks because our borders are not enforced. The people on this thread have their own agenda.”
///
and if you have time after making blanket statements, and claims that are EASILY proved false with little effort, perhaps you’d care to address some of my specifics?

The whole thing is so horrible. They were acting like amped-up Rambos, even saying “bang, bang, bang” in that assassination video. Tucson is notorious for home invasions, and that’s what Mrs. Guerena and her husband apparently thought was happening.

Oh, they took the widow’s WEDDING RING.

It was a drug raid. She will now have to prove that it was not bought with drug money to get it back.

Americans are subject to unconstitutional no-knocks because our borders are not enforced.

Garbage. Americans are subject to unconstitutional no-knocks because of contempt for the Constitution by government agents and their enablers. You're not going to get away with shifting the blame.

Don’t worry. We have your back. You can’t even imagine the number of indignant and outraged posts that would be made if this were to happen to a FReeper.

Ping

Just wonder what you think about this well known, widely discussed 4th amendment issue. What do you think about no-knock warrants when not in “hot pursuit”?

Have you participated in these no knock warrants? Would you?

I think the 4th amendment is pretty clear, and I don’t give a crap what SCOTUS says about the subject. I am educated and can read. SCOTUS is very clearly wrong. The constitution is not really hard to understand.

No, I hadn’t heard that. Do you have a source? I would post it, but someone else would probably get to it sooner as I’m headed out.

If he had fired ANYTHING at them.. there would be bullet holes in the SWAT team or the wall around the door in front of him. Or the tree in the yard, or the house on the other side of the street..

There wasn’t because he did not fire ;)

There is also this:

Jose Guerena was arrested in 2009 but not charged for drug possession, having drug paraphernalia and weapon misconduct.
