Colorado never has had a restriction on carrying and drinking. In other words, you won’t find any law prohibiting doing so or carrying in bar and you won’t find a law allowing so explicitly, either.

We don’t have those silly laws like other States that state no carrying in establishments that make more than 51% in revenue from booze. Yeah, like I am going to ask for a financial statement before entering. We may be a Purple State but we’re still very Western.

Also, Colorado does not define “under the influence”. It is a subjective term that each case must show merit for cause. However, it has been established, obviously, that 0.08 BAC is one established limit, and 0.04 BAC is an established limit for under the influence if not drunk in many jurisdictions, including for pilots. Yes, your pilot can be less than 0.04 BAC if 8 hours after drinking.

So, where do we stand in Colorado? Well, go have dinner or enjoy a BBQ or enjoy the Comedy Club and have a drink, maybe even two, but watch that 0.04 BAC limit. Case law in Colorado also suggests “intoxicated” is the determining factor and that is 0.8 BAC in Colorado, however, it wouldn’t take much for that case law to change if you are 0.04 BAC and doing stupid things with a firearm.
