National Guard is under control of the Governor of the state.

Fed troops can't be used unless there is an act of war by foreign power, such as terrorist attacks.

First there are protest.

Second the protest turn violent and overwhelm police.

Third the National Guard troops are sent in by Governor.

Fourth there are terrorist attacks by the radicals.

Fifth there are terrorist attacks by foreign terrorist which makes it an act of war.

Six the National Guard gives way to Federal troops.

Guess who has absolute power?

My bad, I thought the change in law back in 07 gave The National Guard to the President. You are correct, it is still up to the governor but if he refuses, Obammy can override him. Which brings up an interesting point, are these ‘Occupy’ protests in States with dem Governors?
