Penn State's Legal Liability is Serious, Analysts Say [ 2011-12 budget $279M state appropriations]

In addition to severe reputational damage, Pennsylvania State University faces the prospect of huge financial exposure from lawsuits by sexual-abuse victims who can credibly charge the university had ample warning that its former assistant football coach preyed on children but did little or nothing to stop it, say trial lawyers who have been following the case.

Particularly troubling for the university, at least from a legal liability standpoint, is that the broad parameters of a civil case already are being vividly laid out by state Attorney General Linda Kelly.

Casey says the legal issues are relatively simple. The university had known that a dangerous condition existed on its premises but did not take steps to correct it.

Casey won an $85 million jury verdict in 2008 for a former University of Pennsylvania medical student who plunged through an open manhole cover on his way to classes, shattering his spine.

Jeff Anderson, a high-profile plaintiffs lawyer based in Minnesota who is representing clients in several lawsuits against the Archdiocese of Philadelphia, says the Penn State scandal bears striking similarities to cases of sexual abuse by priests of young boys that have plagued the church for more than a decade.

The problem for all these PSU faculty is that despite this investigation and his removal from the football staff, he was still allowed access to PSU facilities in the presence of children.

I don't know how these people could sleep at night.

A couple questions come to my mind. I wonder if there is a state law making it mandatory for education officials to report suspected child abuse. If there is such a law in PA I wonder if it applies to university staff. My other question is whether some sort of legal settlement associated with Sandusky leaving the football program included a non-disclosure agreement to keep these witnesses quiet.

March 2, 2002 – In the morning, the graduate assistant calls Coach Joe Paterno and goes to Paterno's home, where he reports what he has seen.

And when told of what he saw, the first thing to go through Paterno's head was "Oh not this crap again." Because everybody knew he was doing this. They knew it back in 1998. The police knew about it also, so there was no sense in calling them. It was just something nobody cared to talk about or deal with. Hundreds knew he was doing this. He was just the local guy who liked young boys, which in of it self is not a crime.

Sue them, bankrupt them, throw the guilty and culpable in jail, throw the rest out on the street, knock the buildings down and plow salt in the earth where they stood.

Read my comment under the story..he was not there then according to the stories I pulled up; but I had also thought he was. There is a link above..was looking at that myself in recall. Still above shows a few days ago the Judge in VA said those emails in question would not be released—Universities and funding/grants..again taxpayers right to know kicked to the curb.

So far, so good for Mann, but Fox just reported that the last DemonRat in a contest for a state senate seat just conceded to his pubbie opponent. This may mean, assuming the pubbies have some backbone, VA statutes maight be amended to give the public and the VA AG access to those emails. We can at last hope.

Penn State will be playing Nebraska--would sell to fans for Nebraska but that coach worries about his kids safety with the recent riot. This will still be a heated atmosphere!

Why candles were not just carried with the school song..but instead youths rioting.

Mike McQueary interviewed and really Heated on the subject: Should they even be playing Saturday ?? says sportscaster; but if all just about money for the university. Think this is just going to get better..more on the table we don't know yet.

Jeremy Schaap points out that Joe Paterno wasn't fired as a scapegoat but because he failed to follow a basic human responsibility and you do nothing but become an accomplice knowing this man worked in and around young boys, sudden resignation but still around working with kids and at risk kids at that.

A child molester is not going to stop left in the same environment. Paterno should be gone. A cover-up! All about the money, the safety of kids last.

To answer my own question, it is mandatory under PA state law for educators to report suspected child abuse. From reading the sections of the law I can find on the internet, I still can't figure out if that means the police or just to superiors. I would assume at some point, somebody is required to report it to police.

This could have gone so differently had JoePa grabbed some of his biggest players and physically dragged this guy to the police. The way they worship Paterno in that town, he could have walked into that locker room and put a bullet in Sandusky's melon and they would have never found a jury to convict him. Instead his whole career will be tarnished by this failure in moral courage.

This will be a full employment act for PA lawyers. Would be good if the University officials could be sued personally rather than taxpayers paying the multimillion dollar awards that are likely to come.

Who will pay the court costs for upcoming trials, law suits? The taxpayer as usual?

Who should be included in the lawsuit? All the GLBT clubs at Penn State that foster a cultural environment that allows NAMBLA minded homosexuals to ply their vise. A quick check of the GLBT sites show they are mum about this homosexual perversion carried out at Penn State. Had Penn State tried to clean out the homos in football, they would have been persecuted in the courts just as the Boy Scout have been. The homos are the root of the problem, the unspoken story.

Penn State is morally bankrupt and soon to be financially bankrupt. I do feel sorry for the students that had nothing to do with this and didn’t associate with the moronic behavior last night.

The day this broke, Rush mentioned there is one thing staring us in the face that no one will talk about, not even him.

Now what could that be? Here are the following hints. The gays have about 65 different websites advertised for resources for campus gays. see the first link below. A story by Mark Madden reveals this was all known a long time ago on Penn State. Why the silence? Who dares to stand against the homos. I believe the garden variety of homosexuals consider the NAMBLA faction as allies. They think they will get to pick up the broken boys.

You ask me to come up with evidence? What do you want? You think Jerry Sandusky is simply a heterosexual gone bad. You don't see a a NAMBLA connection in pimping out the boys to old men? See the second link about a story by Mark Madden. The system is cowed by the homo lobby.

The sooner the straight society really grasps the idea that it is under attack by perverts (and the left), it will be able to take measures to neutalize the homo lobby. Until then, the homos will continue to bugger boys.

The Prophet Ezekiel says that God takes no pleasure in the death of the wicked....BUT...if Sandusky were to do the only honorable thing it would spare the victims the trauma of testifying and save the public the expense of a trial.
