Here’s the Eleventh Amendment:

“The Judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by Citizens of another State, or by Citizens or Subjects of any Foreign State.”

What’s it mean?

I posted the Rob Natelson article a month or so ago. It is worth reading.

My initial reaction to the section of the jobs bill that abrogates state’s rights under the 11th amendment was to ask “why?”. Why would the Obama administration want to expand the overreach of the supreme court into internal state affairs? In my limited capacity, I believe this to be obviously related to immigration. The obama administration is trying to become involved in suits brought against a state that will inevitably arise from the strict immigration laws that have been passed in several states.

Nonetheless, constitutional amendments cannot be legislated away. Only additional constitutional amendments can repeal previous amendments, so I doubt that this section in question would hold up in court.

Obama thinks the Constitution should say what the government must do for the people, not just contain restrictions to government power.

More and more centralized power. That’s the ticket.
