I have my doubts about this.

Perry was speaking about prayer in school. He mentioned 8 judges.
Afterwards, his team did some research, had to go back as far as 1963, and found a case involving Bible reading in school (close enough, right?) that was decided 8-to-1. And then Team Perry announces that this is what Gov. Perry was talking about.

I dunno ...

Here’s a partial transcript [Gov. Perry cites the 1962 case]

Question: As president you have to represent all Americans. By saying this president has declared war on religion, some people of this country who are of diverse faiths might read that as you would declare war on their religion.

PERRY: “Well, they would be wrong is how I would say that straight up.”

Question: You talk about state rights in terms of defending the constitution. You don’t see a role for the federal courts to uniformly interpret the First Amendment to defend religious rights in all 50 states?

PERRY: “No, here’s what I see happening with the First Amendment. And this goes back to 1962 and that case where you can’t have an organized prayer to an almighty God as I believe the way it was. I’m not a lawyer and I haven’t studied these cases in depth. But the idea that the court is telling us whether or not we can have prayer in school is really a bit offensive to me. That should be a decision at the local level. It’s one of the reasons I’ve called for doing away with the federal government.

Roughly five minutes later

Question : Just to clarify. When you talk about day of prayer or prayer in schools are you talking Christian prayer or non-denominational prayer?

PERRY: “What I’m saying is it’s not the government’s business to be telling folks that at the state level. Obviously if a school is a Jewish school in Dallas, Texas, that private school should be able to do that.”

Question: They can. The issue is public schools.

PERRY: “Well then the independent school boards that oversee those should make those decisions, not government. Again, I mean, the idea that we have to be so politically correct that there’s one family that says, ‘Listen, I don’t want my child,’ then that child ought to have the freedom — can sit over there and play Tic Tac Toe or what have you. But the issue is that for Washington to tell a local school district that you cannot have a prayer and a time of prayer in that school, I think, is offensive to most Americans. I trust the people of the states to make those decisions, I trust those independent school districts to make those decisions better than eight unelected and, frankly, unaccountable judges. And it’s one of the reasons that I’ve called for the end of lifetime appointments to federal judgeships. I would go to some set term.”

Did I try? I have trouble remembering her name. I don’t fault Perry. Besides, he’s had cases before the Supreme Court.

I was going to say that with at least one of them being more of an Oboma puppet/lobbyist than judge he was right.

Having read the article I cannot.

Here Perry displays his creepiness factor again, I refuse to tolerate a Theocracy, no matter what sect is being anointed, or to vote for anyone supporting such.

So the Perry sticker I had intended to put on my car today, not going to happen.

With Perry and Romney dead to me, the field is narrowing.

Gingrich is not making me happy either, he seems confused as to what he really supports and what he opposes, changing from day to day.

So far it looks like the republican party is trying to surrender the election to Hussein!
Hoping for a serious candidate to appear soon.

According to media, Perry is a dolt!

I remember a REAL dolt who said we have 57 states, but that didn't mean diddly to the media who gush over the faux Messiah's IQ.

Perry would make a much superior President to Obama or Romdiddly in my humble opine.

I admit that Perry is not my guy. I generally avoid attacking him, and I don't feel that I am attacking him here. The partial transcript that you posted helps make the situation look better for Perry than an extremely truncated transcript would, I see that.

Still, that transcript does not completely convince me that Perry was trying to specify just the 8 who voted against the case. I think it's possible he thought there are just 8 judges. But I won't push it. This is a minor point.

I’d have to give Perry a pass on that one. I can never remember her name either. I don’t seem to have problems remembering Kagen’s name. I always call Sotomayor, the one with the “compelling life story”.

Given that Perry had earlier noted a case in 1962 which was in fact decided wrongly by 8 justices the explanation does seem to fit the discussion.
