Santa Clara County sheriff draws legal fire for way she hands out concealed-gun permits

When Tom Scocca applied to Santa Clara County Sheriff Laurie Smith three years ago for a permit to carry a concealed firearm, he thought he had all the right stuff.

Not only was he a former police officer and sheriff's deputy working as a security manager at a major Silicon Valley tech company, he owned an investigative firm and was already licensed to openly carry a loaded gun.

But the sheriff turned him down.

Now that denial is the basis of a federal lawsuit in which Scocca alleges that Smith issues concealed-weapons permits in an arbitrary and capricious way.

He may have a shot. A review by this newspaper of the list of people with such permits indicates that some who appear to have less reason than Scocca to carry a concealed weapon have had no problem getting a permit from Smith.

Only private 49 permit holders in the entire county of Santa Clara? Seems like a pretty small number.

According to Wiki, “As of 2010 it had a population of 1,781,642.”

For decades in all Bay Area counties the sheriffs and chiefs of police have refused to issue permits except for political connections.

The only criteria is who you know.

The people of Santa Clara County who got off their asses and actually voted in Sheriff whats-her-name must like what she is doing. She probably did get the most votes.

A majority of the voters who actually vote, and a majority of the eligible voters are not the same thing. The voters who vote get their people into office, and the voters who do not can eat dirt.

...this is another glaring example of...

ELECTIONS HAVE CONSEQUENCES

...the only present "peaceful" way to end this kind of leftist bullshit is thru the election process (actually casting a ballot)...or recall....if enough people agree.

...the other non-peaceful remedy is not an option....

...presently....

...maybe some sane, non lunatic could never be elected for anything in Santa Clara county, in which case...if you don't like it....either suck it up and live with it, or GTFO....move to a more friendly place.

This reeks to me of infringing on a citizen’s right to “keep” and “bear”. Moonbeam signed a law against open carry, so now in CA you can’t carry open or concealed. I say it’s unconstitutional to not issue a CCW permit when requested by a law-abiding citizen. Is there come hotshot constitutional lawyer out there who can explain how they get away with this?

And you would be correct,...the problem is you will have to provoke arrest and fight it all the way to SCOTUS.

As SCOTUS is now you would likely prevail there now, but change one conservative justice and 2A will likely lose.

And that is after you've spent a couple of million dollars, served five years, and had your 2A rights pulled in a hundred databases that will never be expunged despite the SCOTUS orders to void your original conviction.

Knowing you, Chode, you will enjoy this:

A few years ago, we had a sausage company owner who had a little trouble with a few meat packing health inspectors.

They had been giving him a hard time, dinging him on inspections and imposing fines on his method of making cured sausage.

Nobody had ever gotten sick in 30 odd years of production, but they knew best.

An inspection escalated into a fight and the sausage guy ventilated the inspectors with his concealed handgun.

We used to joke that he planned to make sausage of 'em.

I have about two dozen friends and acquaintances in the Bay Area meat packing industry, and to a man the word is Stu wouldn't "comp" the inspectors.

For the inspectors, it's an envelope full of cash, for the cops it's all the best meat they can eat.

The cops are smarter, they don't tell ya how to make your product, they just tell ya how good it tastes.
