How do you know he personally guaranteed the loan? Is the contract public record? And even if that is true, how can you know that amount he would have had to pay exceeds his assests? That certainly is not public record and does not seem likely, frankly.

The $40 million personal guarantee and his liquidity situation became public when Trump was sued for default by Deutsche Bank in Nov 2008.

To be personally bankupt his liabilities would have to exceed his assets. That, after all, is the definition. $40 million would not seem to exceed his assets, which include a heavy revenue stream that is constant as well as equity in a very large number of valuable pieces of commercial real estate. Where can you show that in the law suit that you mention there is proof of what you say? I doubt if you have any such specific knowledge, frankly. I believe that you are blowing smoke and I very much doubt if you can back up what you say.

As I surmised, your representations are completely without support. The memorandum in support of the motion for summary judgment does not reveal anything whatsoever about Trump's liquidity. It does not purport in any way to state, and certainly offers no assertion that his assets would be exceeded by his debt should he pay the $40,000,000 in question. In fact the memorandum points out that he is on record as saying that he is worth billions, so that paying $40,000,000 would be no problem whatsoever. Moreover, in the article linked on one of the posts, he is quoted as saying to a reporter, regarding the entire loan, not just the $40,000,000: "But for me, it's not a lot of money, you understand." Further, earlier in the same article it is revealed that just a few weeks before he had bought out his joint venture partner, in the Chicago project, which clearly would have been more than the $40,000,000. I have suited myself, as you say, and examined your "proof." It does not provide a shred of evidence to support what you say. You either are ignorant of what bankruptcy is or are badly misrepresenting matters. BTW, you should be aware that there are innumerable cases holding that what you have said is per se defamatory. You should be more careful.

What Trump filings? There are no “Trump filings” that reveal what you assert is true. You continue to blow smoke. The only way his personal worth would be revealed so that the public might see it would be if he actually did file for bankrutpcty. So far you have been unable to produce a thread of support for your misrepresentations. If there is such proof then show us. Otherwise, I repeat, you are either ignorant or blowing smoke. Which is it? By the way, inability to pay is not a defense that any lawyer would raise in such litigation.
