Technically correct but I seriously doubt the cops would have shot him if they knew it was just a pellet gun. Just like lawn darts are a toy but can kill you if they hit in the right place. Not too many people shot brandishing a lawn dart.
Last I saw, a lawn dart didn’t look or handle like a weapon...just sayin’
