A Connecticut mother reportedly received an unusual gift for her 98th birthday from her eldest son -- eviction papers.
Mary Kantorowski, who has lived in the same Fairfield, Conn., home since 1953, is now facing eviction from her yellow, Cape Cod-style home valued at $333,410, the Connecticut Post reports. Her son Peter Kantorowski, 71, a retired taxidermist, said he's doing it for her own good.
"She would be better off living with people her own age," he told the newspaper.
According to Probate Court records, Mary Kantorowski and her husband, John, agreed to transfer the house to a trust administered by Peter Kantorowski on the condition that Mary would live there until her death, and upon her death, the house would go to Peter and his younger brother, Jack, the newspaper reports.
In July 2005, however, Peter Kantorowski quitclaimed the house from that trust to another he and his wife control, giving him ownership of the house. Six years later, in Dec. 13, 2011, his mother's 98th birthday, Peter Kantorowski had his mother served with eviction papers.
"This is just a despicable situation," said Richard Bortolot Jr., a Stratford lawyer appointed by Fairfield Probate Judge Daniel Caruso to represent Mary Kantorowski. "Mary has been living here happily paying all the expenses for the house and now her son, Peter, comes along and is telling her, 'Get the hell out,' so he can sell it."
"My husband worked hard, difficult jobs to buy this house," Mary Kantorowski told the Connecticut Post. "He built the garage and did a lot of work on the house and he told me never to leave it."

The younger Kantorowski, who said he and his fiancee visit his mother twice a week, said his brother once told him he felt their mother had lived too long.

Peter Kantorowski said he has invited his mother to come live with him, but she has refused.
"I have this big house in Trumbull and she is welcome to come live with me," he said. "I took care of my mother-in-law until she died in my house."
She's old, not stupid.
Well, if the judge visited the woman, we DO know the whole story. In the case that I was referring to, the woman seems to be agoraphobic. Her home if over flowing with collections (dolls) and purchases from the Shopping Channel, mostly not even unwrapped, even filling the old outdoor basket ball court. Some of the outside mess taken care of, after the neighbors complained.
No judge would visit the house and consider the woman to be stable, even though she is educated and can still hold a normal conversation. She doesn’t sound nuts at all.
Wonder how this POS’s health is? Hope his kids are taking notes.

My friend, who just passed at 101, sure did.
It was a bitch to find anyone besides family to inform of her passing.
Hell, the last of her siblings, her sister, passed away two months before and we didn’t tell her about it.
Boy did she get a surprise when she got to heaven.

You got all that info from the very same media that, we all know, is crazy. They want outrage. They want the government to run our lives because mean men steal from their own mothers.
The son could be innocent of your charges.

I know my parents are in their late 70’s but to me, they own their property and it would NOT be right to pull something like this.
If my parents really needed to go to a full time assisted living place, I don’t know if I can bring myself to kick them out of their property and would instead try to find a way where they can get someone to come over to care for them.
Wouldn't that have violated the terms of the original trust agreement?

The mother has a tidy house.
She talks pretty good for a woman her age.
She has a nurse that regularly checks in on her.
She has a younger son who visits her almost every day.
The older son who is kicking her out has not seen her in eight months.
He said the reason he has not visited her is because he does not have a key.
He is evicting her but has made no plans where she is to go.
Their info comes from court records and interviews with the involved parties, so it's easily checkable.
They want outrage. They want the government to run our lives because mean men steal from their own mothers.
The son is trying to get the government to evict his mother from her own private home and place her into a state-supported facility.
If the agenda behind this article was promoting big government, they chose an unlikely hero in this man.
The son could be innocent of your charges.
Only if there's a massive conspiracy against him that includes the collusion of his entire family, his attorneys, his mother's attorneys, the county clerk, the county sheriff, the local newspaper and the state judiciary.
He tried to get slick and he got caught.
The root cause of Peter’s evil behavior is most probably his lack of retirement assets. He is probably trying to make it on his monthly Social Security check. This will not support him in the manner that he envisioned while working, eying his mother’s house, and waiting for her to die so he could come into possession of his retirement plan.
Alas, she has lived much to long and at 71 and male, he feels that his time is elapsing as well. He got impatient and did something evil.
While that property may be assessed at 300K today after the real estate bubble burst, its market value is higher and it may have fetched double that in the late 90s as the Greenwich hedge fund explosion took off.
The house is right off 95, a 15 minute drive from Greenwich.
He may have thought: "No need to save - in a few years I'll get a check for a few hundred grand."
Also, I did a little searching. She moved into the house in 1953. Cape Cods on her street from the 1950s are listed at over $400K and they seem to have an average of 1,050 square feet.
So, in this case, this one case, the media does excellent work?
Yeah, there are always sleazeballs around, who are more interested in their inheritance than they are in their parents’ well-being. We had a local guy, who had right of attorney for his mother and “invested” all her money in his own home. He’s now in jail.
In this case, with a property that is only worth, $400,000, the assisted living arrangements would cost more than the property is worth, unless he was just going to put her in some group home.
This article could have been much better (like explaining how a quitclaim works) and given more details.
It's hardly an "excellent" article.
But it does contain assertions that, if false, are easily checkable by consulting publicly available records.
If this article is made up, they've handed the subject a readymade, slam-dunk libel judgment.

A Cape Cod house is not huge. Our current home (which we are renting until we buy this summer) was built in 1950, and is a Cape Cod style. If you subtract the master bedroom suite and the living room/bathroom that were added on in later years (70s and 80s), it originally consisted of 2 bedrooms downstairs, a formal dining room, a kitchen, two dormer rooms upstairs, and one bathroom—and none of the 4 original bedrooms were overly big. The house as originally built would have been tiny for our family of six. Assuming that this woman’s house is pretty much the same size as it was when it was built, it probably isn’t the Taj Majal (sp?).
If someone wants to downsize and give their home to a family member, more power to them. This woman likes where she is and she should stay there.
My in-laws (who have no children at home any more) have a five bedroom, three bathroom home on 14.5 acres in Indiana. Tell them they need to give it up for the greater good. They worked their whole lives for that dream.
Oh, sure. The worst is that old piece of gossip about that guy walking on the moon. And that gossip about the Greeks defaulting on their sovereign debt. Whoever discusses that stuff should be embarrassed.
