A Slinger homeowner who fatally shot a 20-year-old West Bend man who was hiding from police inside the homeowner's enclosed porch will not be charged, the Washington County District Attorney's Office announced Wednesday.

Bo Morrison was among a group of people who fled from an underage drinking party in a nextdoor garage and was hiding inside the porch when he was shot about 2 a.m. March 3.

The homeowner acted lawfully and in self-defense when he armed himself, encountered Morrison in the darkened room and killed him with a single gunshot from a .45 caliber revolver, the statement says. Authorities have not identified the homeowner.

Wisconsin's castle doctrine law presumes homeowners are justified when using deadly force against intruders.

The law, passed by the Legislature in November, covers places like patios, porches and garages.

According to the district attorney's office report on the incident:

Shortly before 1 a.m. the homeowner was awakened by loud music coming from the property east of his home, walked outside through the back porch and heard loud music coming from a car in a driveway.

After pounding on the car and telling a female inside to turn down the volume he got into a brief verbal confrontation with the car's occupants before going back inside his residence and calling police.

When officers arrived they heard loud music and noise coming from the detached garage but it subsided after police knocked on the garage door.

The officers heard talking and laughing inside the garage and tried forcing their way through the door but it appeared the people inside were holding it shut.

A man who lived in the residence on the property was asleep, so one of the officer's called the man's wife, who was at work, and told her citations would be issued to them

Up thread I relayed the story of the young man who was legally and morally shot dead at the side of I-25 in Colorado Springs.

I’ve heard his father speak. His father has, and seems to still have, a chip on his shoulder the size of Pike Peak. Most likely the son inherited that same attitude, and that foolishness cost him his life.

I know very little about you, beyond what you’ve revealed on this thread, but I’m beginning to suspect you are of similar bent.. You’re doing your son a great, and possible deadly, disservice.

If your son has inherited that same attitude from you, he’d be well advised to avoid Colorado, and most other states with Make My Day laws, as history has shown we aren’t hesitant to use the powers of self defense that Our Maker has given us, the State has codified into law, and the gun makers have made possible.

Ah, no worries.

My son, when he was in high school, was having some trouble with some punks over something that was said by my son’s friend. It was getting really stupid. Dangerously stupid.

I ran into their little ringleader down at a fast food place and invited him outside, told him who I was, and explained some things.

I heard he went running to his daddy and told him what I had said. I heard his dad kicked the living crap out of him. Told him how stupid he was.

From the article: The man told investigators he heard noises by the back porch, thought someone might be breaking in and grabbed and his loaded revolver.

So which is it, "and" or "his"? Both words work and have an immense impact on the story.

" Probably a typo, which should have been "and grabbed and loaded his revolver."

I have read the prosecutors report, which clearly states that the shooter got his revolver and loaded it.
