The US Supreme Court today heard arguments today on what may be the most important constitutional case in a generation. Some of the nation’s top attorneys are debating the Patient Protection and Affordable Care Act, often known as Obamacare.
The eventual ruling could chart the boundaries of federal power for generations to come – not only for health care, but across the policy spectrum.
A major focus of the Supreme Court hearings is the individual mandate – the law’s requirement that almost all Americans who aren’t covered by employers must purchase a health-care plan, whether they want to or not.
The plaintiffs – including 26 states as well as individuals and businesses – argue that Congress has no authority to force people to buy insurance. Most Americans agree: A recent Gallup poll found that 72 percent – including 56 percent of Democrats – consider the mandate unconstitutional.
Obama administration attorneys counter that Article I, Section 8 of the Constitution, known as “the commerce clause” – giving Congress power to “regulate commerce among the several states” – is more than expansive enough to validate the mandate.
They rely on a list of Supreme Court precedents that stretch the definition of “interstate commerce” pretty far.

I only hope that at least one liberal justice will side with the conservatives to give the vote more than a simple majority.

I have always considered myself an expert on the Constitution for two simple reasons: I understand simple English, and I am not a "progressive" or "Socialist" lawyer.
I have always considered the Bill of Rights sacrosanct. In other words, no new law, even a Constitutional Amendment can invalidate any of the 10 amendment or any of their parts.
If the incremental erosion of the clear meaning of the original Constitution can be canceled by expanding the "commerce clause," the Bill of Rights no longer has any meaning.
In the modern world, there is no activity, need, product or service that can't be pounded into the square peg definition of round hole "Interstate Commerce" clause.
And if there has been any formal and conclusive eradication of the Tenth Amendment, I am not aware of it. Show me a bill that says "the Tenth Amendment is hereby superseded by this law." The Bill of Rights is not subject to modification.
The powers not delegated to the United States by the Constitution, nor prohibited by it (the Constitution) to the states, are reserved to the States respectively, or to the People.
The right of the individual to run his own life, including health care, was a linchpin of the new free republic. Hard to believe that every tiniest aspect of a citizen's life was intended to be subject to its manipulation by the Central Government.
Until we as a nation reject the collectivist premise behind all these nanny state programs, it is not possible to turn this around. Under freedom, there is no way around the fact that some will do better than others. Some people are just smarter, some will work harder, some will be born into better connections, and on and on.
The left just can’t abide it if some have more than others. They feel compelled to even things out, whatever it takes to do it.
I’ve been thinking about this for some time now and with that being said I believe the following points to be both true and valid.
1. Obamacare is the gateway to total slavery of all U.S. Citizens. If this law is found to be constitutional then our Civil war in the 1860’s that was partially fought over the cause of slavery has finally been lost.
2. Using the excuse of Government Health care then the Government can legitimately claim that they own our personal bodies and can dictate what we eat, where we live, what we do for a living, (for those who work). Even what we wear for clothing.
3. If the Government owns our personal bodies that means it also owns the issue of our bodies. That means any children we have are not our own and can be removed from us to be reared in a Government approved facility.
Yes, I know some will think of this as being radical, I am just attempting to do a logical extrapolation of the intended and unintended consequences of this ruling by the Supreme Court.
You aren't being any more radical than the idea of same-sex marriage sounded back in, say, 1977. And look where we are today.
One can’t be forced to enter into a contract under duress. This case may have nothing to do with the constitution, but it may fall under simple contract law.
With the government already controlling the size of your toilet tank, the wattage of your light bulbs, and the thermostat setting of your house, they already DO micromanage your life.
But gay sex is legal now so nobody in the media give’s a rat’s a**.

If Obamacare becomes law then you can kiss goodbye law and order and certainly any respect for the Supreme Court.
Anyone who can read simple English language can understand the Constitution and what it allows the Federal Government to do.
This has come down to Progressives pushing an agenda against the will of the American people, against the Constitution, and it has to eventually come to a conclusion. I do think that the Supreme Courts decision in this matter is pivotal.
Can not imagine an outcome that is non-violent if the Supreme Court rules otherwise. That is a real shame since we are suppose to be a law and order society. Progressives are pushing law-abiding folks into this fight and if the Supreme Court agrees with them, it will be their fault.

I’ve been saying since the start of this Obamacare disaster that, in order for the government to compel one to purchase a product as a condition of living, the government must assert OWNERSHIP over the individual citizen. On what other basis can they assert the power to force you to do something you refuse to do?

The Federal Government forcefully taking a man’s life out of his own hands and instead places his fate in the hands of others. No longer are his choices & providence be meaningful because the outcome will be set by the discretionary of Federal government bureaucratic.
now the young and reckless will reserve just as much care as the old and frugal. No longer will making good choices to save for emergency’s and to live healthy make any difference.
The very essence of our lives as defined by our choices is sap so that anther does not have to live with their poor & less responsible choices.
When you think about it, this is the essence of leftist thinking when it comes to welfare & abortion as well. In both cases people who have made poor choices have the consequences of them poor choices redistributed to those who have good choices. With every act of redistribution The leftist government robs all men of their freedom, their individual merit, and thus in a very real sense the essence of their lives.
The right to rise & fall by the choices you make is the essence of merit, the essences of living free.
