Video: Obama Pre-emptively Lashes Out at "Unelected" Supreme Court
Townhall.com ^ | April 2, 2012 | Guy Benson

Posted on 04/03/2012 1:53:51 AM PDT by Kaslin

Following last week's dramatic Obamacare oral arguments, the Left appears to be anticipating a legal defeat when the Court releases its ruling in June.  To lay the groundwork for a shameless campaign of anti-SCOTUS recriminations, liberals have begun a coordinated attack on the Court's legitimacy and reputation.  Democratic Senators have fired early shots, as have several prominent Democrat Party strategists.  And today, as expected, President Obama joined the pre-emptive pile-on:

President Obama attacks Supreme Court on health care

Ultimately I am confident that the Supreme Court will not take what would be an unprecedented extraordinary event by overturning a law that was passed by a strong majority of a democratically elected congress," Obama told reporters today while speaking with Canadian Prime Minister Stephen Harper and Mexican President Felipe Calderon. "I'm confident that this will be upheld because it should be upheld." Obama concluded.

A few thoughts:

(1) That last quote will go down in the annals of presidential tautological tautologies. The law "will be upheld because it should be upheld."  Such insight!

(2) Yes, the US Supreme Court is -- and always has been -- an "unelected" body.  And?  Are you hinting, Mr. President, that the American people ought not respect the final decisions of the High Court, or that the institution no longer serves as the ultimate arbiter of constitutionality?  Such a departure would, indeed, be "unprecedented" -- the true definition of which appears to elude our Harvard Law graduate president.  Also, since when does this president object to panels of unelected, unaccountable federal appointees making decisions about people's lives, with no possibility for further appeal?  Suddenly, it's no longer a feature.

(3) In all seriousness, in what conceivable way would SCOTUS striking down a law it determined to be unconstitutional constitute an "unprecedented" act?  Supreme Court majorities have been doing exactly that since establishing the practice of judicial review in 1803's landmark Marbury v. Madison decision.  Heritage's Lachlan Markay reports that the Court has struck down 53 federal laws in the last 30 years alone.  Unprecedented!

(4) Actually, a "strong majority" did not pass Obamacare.  You'll recall that the 24 hours directly preceding Obamacare's passage was fraught with desperate vote whipping and deal-making.  It was eventually dragged across the finish line in the House by a razor-thin margin, with dozens of Democrats joining a united Republican front opposing the law.  Besides, the size of a congressional majority has no bearing on a law's root constitutionality -- a point one might assume a former law school lecturer would grasp.

(5) As for the president's "confident" (is he ever anything but?) prediction that the American people won't stand for such an exercise of "judicial activism," perhaps the president should re-examine, you know, virtually every single piece of polling data on the matter.  In fact, the American people are demanding that the court rein in the Reid/Pelosi Congress' worst piece of legislative excess.  Note the views of Democrats:

I'll leave you with this reminder of how liberals greet closely-divided, highly-charged Supreme Court decisions with which they concur:

"It is a decision of the Supreme Court. If Congress wants to change it, it will require legislation of a level of a constitutional amendment. So this is almost as if God has spoken. It's an elementary discussion now. They have made the decision."

Finally, the critical reminder that we genuinely do not know how the Court will rule on this case.  Anyone who tells you otherwise isn't shooting straight.

This democrat cretin Obama is worse than a communist dictator like Chavez or Mugabe.

Obama has piled on 5 trillion $ in debt on us, greatly expanded government size and tyranny, let in illegals, sent our jobs to China, censored the Internet with ACTA, and has committed a million other crimes.

All democrats are marxists especially all the reporters in the mainstream media.

One of these people is about the dumbest to ever be appointed to SCOTUS.

One of these people is about the smartest to ever be appointed to SCOTUS.

And the third is just a dumb arrogant pr***!

"Kagan has talked as they voted Friday."

Yup!

Their only hope now is to demonize the court. Watch for lots of media hit pieces from now until June - vicious attacks on individual justices as well as the Court in general.

I give that a 99.9999999999999999999999% probability.

There is an obvious vast left wing conspiracy in play with the Democrats.

To me they come across as Americans ignorant of constitutional law, of the separate, but equal roles of our three branches of government, and of respect for the intelligence of the American people they are supposed to represent and respect.

Maybe he’ll just replace the SCOTUS with ACORN? That’ll work.

Interesting how many of the “elected” voted against the will of their constituents. And several lost their seats because of it. (i.e. Blanche Lincoln)

Quite an amazing comment coming from a "Constitutional Scholar."

No, Mistuh Prezident. That's exactly what the Supreme Court is supposed to do. I know, because I looked it up in the Constitution.

One of the major problems with the health care issue is the Republicans have been unable or unsuccessful in articulating and promoting an alternative to Obamacare. The absence of a viable alternative to the current health care mess, makes Obamacare attractive to many of our fellow voters.

The current situation situation is very difficult to work with - portability, preexisting conditions, confusing billing, in and out of network physicians, arbitrary regulations based on averages which tie the doctor’s hands in care are just some of the issues citizens struggle with. Consider a 50+ self employed person who has preexisting cancer (in remission) who moves from one state to another. Try to get health insurance at any price, even from the same insurance company. Alternatively, spend a few months trying to oversee the health care of aging parents including managing their billing. Call your insurance company about a billing problem, spending frustrating minutes trying to work through the computer questions before finally being transferred to a call center in India where you spend hours trying to communicate with someone not fluent in English and not knowledgable about the insurance policy or the treatment.

In the case of health care there is a perception in the populace the Republican position is to do nothing — let the market work it out. People dealing with the system day by day don’t have time for the market solutions (should they ever come) and want relief from the byzantine rules and regulations driving up costs, reducing the quality of care, and making their lives miserable dealing with the system.

It isn’t going to be enough for the Republican nominee and the Republicans running for Congress to simply oppose Obamacare or advocate repeal of Obamacare. The status quo is unacceptable for most voters and Obamacare has not been implemented so the voters don’t know if it will or won’t work. If the Republicans can’t articulate and advocate a superior alternative, I fear many voters will just tune them out on the issue.

Obama: Congress will not do what I want -— so I will do it myself

Obama: The SCOTUS will not do what I want -— so I will do it myself.

Here is the speech I expect to hear as he makes his case to the gathering mob:

The system is broken.
We allow racists to shoot black children without investigation, we allow the weakest to be denied healthcare and we allow the wealthy to prosper while the poor are denied.

We allow oil companies and corporations to get tax breaks while families go hungry.

We treat latinos who come to this country for work, doing the most menial jobs, as invaders.

This nation is broken and it is time for a new constitution to be written. A constitution that reflects our values, reinforces our principles and levels the field for rich and poor, corporation and mom & pop.

The Supremes have utterly failed on several occasions to answer ... or better said, even consider ... two fundamental Constitutional questions brought before them :

Is Barack Hussein Obama, Jr.
a Natural Born Citizen as required by Article II?
Is he in office legitimately?

It is supremely ironic that now Barack Hussein Obama, Jr. is calling THEM "illegitimate."

This would make a perfect campaign issue from now on until the election, especially by the Nominee
