Louisiana is the only state under Napoleonic law.

I was surprised to hear a definition of “burglary” that said anything about time of day, but spel is correct!

This thread reminds me of the news in my area, Washington State. Whatever legal term it is I don’t know, but home invasions are in the news a lot more as of late - and the owners are fighting back.

On Wednesday afternoon, a retired police officer shot and killed an intruder at his home near Puyallup....A police source told KIRO 7 Eyewitness News, “It’s open season on burglars.”

In Bonney Lake, another homeowner took a shot at a burglar Thursday, possibly hitting the burglar’s truck window as he fled the home...The homeowner heard a pounding noise as a man tried to kick down his front door, police said. The homeowner ran outside with his shotgun in hand as the man hopped into a pickup.

“That is when the homeowner fired one shot from the shotgun in the direction of the vehicle,” Bonney Lake police Officer Todd Green said.

Interesting. . .but from Section §30 of the Texas Penal Code, there is no reference to time of day:

§ 30.02. BURGLARY. (a) A person commits an offense if, without the effective consent of the owner, the person:
(1) enters a habitation, or a building (or any portion of a building) not then open to the public, with intent to commit a felony, theft, or an assault; or
(2) remains concealed, with intent to commit a felony, theft, or an assault, in a building or habitation; or
(3) enters a building or habitation and commits or attempts to commit a felony, theft, or an assault
