Supreme Court refuses to take up voter ID cases (WI)

Madison - The state Supreme Court refused Monday to immediately take up a pair of cases that struck down the state's new voter ID law, a decision that will likely mean citizens won't have to show ID when they cast ballots in recall elections this spring.

The court's terse orders send the cases back to two different courts of appeals. The appeals courts had said the Supreme Court should take the cases right away because of their significance. Now, the appeals courts will have to render their own decisions on the cases.

The cases could then go to the Supreme Court, and are widely expected to be decided by that court.

But in the short term, the rulings mean the voter ID law will remain blocked. The court issued its orders just three weeks before the May 8 primary for Democrats to pick a candidate to run against Republican Gov. Scott Walker in the June 5 recall election.

The appeals courts had said the Supreme Court should take the cases right away because of their significance. Now, the appeals courts will have to render their own decisions on the cases.

The cases could then go to the Supreme Court, and are widely expected to be decided by that court.

There is a PROCESS ... follow the process. Of course the US Supreme Court is going to demand that the process be followed. They did the right thing. Let the Appeals Court render a decision, and THEN it can go to the US Supreme Court.

Of course the US Supreme Court is going to demand that the process be followed.

It was the WI state supreme court that rejected the case, but your point that there is a process to follow is still valid.

All conservative shop owners, bar maids, etc, should stop asking for any kind of ID for any reason in protest to this.

WI citizens should refuse to show ID to any public officials for any reason.

Businesses should refuse to ask for ID for any reason.

See how long that lasts.

We’re talking about the STATE Supreme Court here. The AG wanted to go directly to the State Supreme court because he knows that it will be appealed to the US Supreme Court no matter who prevails. It is a standard short cut in election cases.

This is the reason that the Dems are so focused on getting Justice Prosser kicked off. The Dems want to be back into control here. Now we’re going to have to go through appeals and then a big fight over who actully gets to sit on the Wis State Supreme Court for the case and then on to the USSC. We’ll be lucky to have voter ID for November, let alone the recall.

I’ve lived here 27 years, and I’ve seen Voter Photo ID passed numerous times and watched the Dems scuttle it in every instance. It truly is disgusting. Makes you almost lose faith in the democratic process! sarc/off

Voter fraud is of little concern for the May primary recall election. After that the stakes are higher for the general recall elections and the Nov. general election. The question I have is if the WI Supreme court eventually rules this as Consitutional, will the highly politicized US DOJ find some bogus pretext to block voter ID. Or, after an appeal to a federal court, will the federal court block the voter ID law just in time for the general?
If the WI Supreme court is smart (5-4 conservative), they will time their ruling for the recall or general carefully.
