Sebelius admits she did not consult Supreme Court decisions on religious liberty when drafting HHS mandate

In this morning’s Congressional House hearing, Sebelius admits she did not consult Supreme Court decisions on religious liberty or have a legal memo prepared before she drafted the mandate. The mandate, unprecedented in American history, forces religious institutions to pay for contraceptives, sterilizations, and abortion-causing drugs, including the morning-after pill and the week-after pill, against their deeply held religious beliefs. She opened a door for him and for the life of me, I do not understand why they did not persue the lead she willingly offered.

She said she had “meetings” about this. Immediately this congressman should have asked for minutes from that particular meeting. Then, I would also immediately ask if who attended that meeting. Then, if the president was in any of these meetings. What knowledge did the president have of this attempt to subvert the constitution?

I would have asked her, under oath, if she knew or was advised at any time that this provision was in contravention to the constitution. There is much that could have been said here and asked here.

Dictator’s are not concerned with the Constitition or the rule of law. Sebelius may as well be Chavez or Castro.

Romney, with all his imperfections, looks like Braveheart compared to Obama and his band of thugs.

Supremely arrogant, yet stunningly ignorant, thugs.

Given that virtually the entire administration was recruited from the halls of academe -- the stupid Sibelius an exception -- that says a lot about the state of academe these days.

That is why I don’t watch this kind of stuff anymore. Noone ever follows up with the right questions whether it is a congress person or a news reporter. They let them answer the question and then it is just on to the next question.
I get frustrated just watching it.

Many here on FR, including me, have not been Mitt supporters, but imagine a Supreme Court with another Obama appointee or two.

I wonder if people really believe that the 1st amendment protects people from legislation, via religious objection, where other people with similar objections rooted only in principle, are subjected to federal jurisdiction.

Seems pretty insulting to Americans that one can only refuse a contraception mandate if one is a member of an organized religion.

I've not been a huge fan of Romney (although I wanted him over Juan McCain last time)....That said, ANYBODY, AND I MEAN ANYBODY would be better than Obama. Clinton, at least had an appreciation for the country as founded (in a way)...this bitter little sissy and his horrid gang clearly think the country needs to be dismantled. They being so smart and evolved, will remake it in their image.

Romney? I'm going to get on that train. I've been reading a bit about his personal life. He accomplished more before 21 then Obozo has in his whole crappy life. Plus, I like his wife...she is the opposite of that fat harpy, know it all, idiot, beard (and FIT, international style icon!) we have now.

And...that speech Romney made after he won the 5 states, the other night? It was very, very good. Gave me a bit of a tingle up me leg! Who knows what this man will do with his opportunity in the WH....He could be the best President ever and get our country back on the rails. He really could. I'm praying we get to see him get his chance.

Kansas didn’t like the woman, either. The citizens were very glad to see her go.

I’m not sure why Sebellius, or anyone in the Administration (or any administration for that matter) would ever consult the Supreme Court on matters of Constitutional law; the Supreme Court speaks through its decisions, and is not supposed to act in a consultative fashion. The Justices don’t like commenting on ANY issue that may come before them, and I don’t recall ever hearing of a major point of Constitutional law where the Supreme Court was consulted ahead of time.

The question about having an internal study/memo/whitepaper drafted is absolutely valid and its surprising that one wasn’t prior to the decision to put the policy in place.

There is nothing to stop him from a follow up communication asking for all that and more. But his time was clearly running out, it’s not as if they have all the time in the world. Given the limits of the time afforded him, Gowdy did a very impressive job.

Religious freedom means something and so does the government killing people through centralized denial of health care as decided by death panels. The government can only murder the unborn = the innocent.

This election is for all the marbles. It’s really a choice between electing a president who will respect our laws and Constitution and restore economic vitality or a dictator who wants to abolish our rights and freedoms, dismantle the country and destroy the economy. To me its a no brainer. For those thinking about sitting it out and not voting for Romney, think Supreme Court and the irreparable damage Obama could do with his appointments.
